【摘要】：律師執(zhí)業(yè)條件是制定律師制度的基礎(chǔ),律師執(zhí)業(yè)條件制度的完善直接對選拔什么樣的人才進(jìn)入律師隊伍產(chǎn)生直接的影響,這正是本文的最后落腳點。律師執(zhí)業(yè)條件制度主要包括兩個方面的內(nèi)容,即律師執(zhí)業(yè)資格考試制度和律師執(zhí)業(yè)證書的取得制度。具備律師執(zhí)業(yè)條件是選拔律師人才的基礎(chǔ),其重要性自然就不言而喻。但是,在實踐中其重要性似乎并沒有充分表現(xiàn)出來。實踐中出現(xiàn)的對參加律師資格考試人員的選拔標(biāo)準(zhǔn)不嚴(yán),選拔標(biāo)準(zhǔn)不一致,以及對于申請獲取律師執(zhí)業(yè)證書的人員疏于管理,過于走形式等等都阻礙了我國的律師制度的發(fā)展。本文在分析我國律師執(zhí)業(yè)條件制度不足的基礎(chǔ)上,采用對比分析的方法分析了域外法律發(fā)達(dá)國家的律師執(zhí)業(yè)條件制度,在剖析對比的基礎(chǔ)上,指出我國律師制度在此方面的不足之處,借鑒國外在此方面的成功經(jīng)驗,從而提出一系列完善我國律師執(zhí)業(yè)條件制度的建議。 本文除前言和致謝外,約2萬字,正文分為三大部分： 第一大部分為我國律師執(zhí)業(yè)條件制度的現(xiàn)狀。本部分又包括兩小部分：我國律師資格取得制度的現(xiàn)狀和我國的律師執(zhí)業(yè)證書的獲取現(xiàn)狀。本部分主要從國籍條件、政治條件、業(yè)務(wù)條件和品行條件,對我國現(xiàn)有的律師執(zhí)業(yè)資格制度一一總結(jié)和陳述,最后,通過剖析,得出我國現(xiàn)有的律師執(zhí)業(yè)資格制度的不足。 第二大部分為國外律師執(zhí)業(yè)條件制度的比較。本部分同樣也是包括兩小部分：域外律師資格取得制度的現(xiàn)狀和域外律師執(zhí)業(yè)資格證書的獲取現(xiàn)狀。本部分主要包括英國、美國、德國、法國相關(guān)的律師資格取得制度的現(xiàn)有規(guī)定。主要采用采用對比分析的方法,主要是從以下幾個方面闡述：現(xiàn)行的實習(xí)制度、現(xiàn)行的品行考察制度及其他相關(guān)規(guī)定,總結(jié)出域外律師執(zhí)業(yè)條件制度的優(yōu)越之處。 第三大部分為我國律師執(zhí)業(yè)條件制度的完善。主要包括完善學(xué)歷條件制度,完善律師執(zhí)業(yè)資格考試,明確實習(xí)活動中的權(quán)利,規(guī)范律師業(yè)務(wù)實習(xí)的管理,完善實習(xí)期限的規(guī)定和完善品行考察制度。
[Abstract]:The lawyer ' s practice condition is the basis of establishing the lawyer system , and the perfection of the lawyer ' s practice condition system directly influences the selection of qualified personnel into the lawyer team .

In addition to the preface and thanks , the text is divided into three parts :

The first part is the current situation of China ' s lawyer ' s practice condition system . This part also includes two parts : the present situation of the legal system of lawyer qualification in our country and the acquisition status of lawyer ' s practice certificate in our country . This part mainly summarizes and statements the qualification system of lawyers in our country from the condition of nationality , political condition , business condition and morality . Finally , through the analysis , we conclude that our country ' s current lawyer ' s qualification system is insufficient .

The second part is the comparison of the practice condition system of lawyers in foreign countries . This part also includes two parts : the present situation of the system of the qualification of foreign lawyers and the acquisition of the qualification certificate of lawyers in extraterritorial laws . This part mainly includes the current regulations of the legal system of lawyers in the UK , the United States , Germany and France . This part mainly includes the following aspects : the current practice system , the current product inspection system and other relevant regulations , and summarizes the superiority of the practice condition system outside the extraterritorial lawyer .

The third part is the perfection of the practice condition system of lawyers in our country . It mainly includes perfecting the educational background condition system , perfecting the qualification examination of lawyers , clarifying the rights in practice activities , regulating the management of lawyers ' business practice , perfecting the rules of practice period and perfecting the inspection system .
