【摘要】：正人民法院作為國家審判機(jī)關(guān), 其主要職能是審判,但人民法院在行使審判權(quán)的過程中,既會涉及到作為審判機(jī)關(guān)與訴訟參與人之間的關(guān)系,也會涉及到人民法院作為國家機(jī)關(guān)與其他國家機(jī)關(guān)如何處理審判權(quán)的關(guān)系問題。相對于人民法院改進(jìn)審判方式而言,如何在處理人民法院與其他國家機(jī)關(guān)之間的關(guān)系上有所變革、有所創(chuàng)新,特別是人民法院能否依據(jù)憲法和依據(jù)法律行使一定的立法權(quán)來強(qiáng)化自身的審
[Abstract]:As a state judicial organ, the main function of the people's court is to try.
