【摘要】：我國最高司法機(jī)關(guān)就檢察機(jī)關(guān)開展量刑建議工作達(dá)成共識(shí)，量刑建議作為刑事訴訟中的一項(xiàng)具體訴訟制度被確定下來。作為法律監(jiān)督職能的重要內(nèi)容，，檢察機(jī)關(guān)提出量刑建議，不僅保障了刑事案件當(dāng)事人的訴訟權(quán)利，還監(jiān)督制約了量刑裁判活動(dòng)，有利于保障量刑活動(dòng)的公平、公正、公開。量刑建議在司法實(shí)踐中實(shí)施近兩年來，其制度功效在一定程度上得到了有效的釋放，但仍存在一些問題，如量刑建議的觀念障礙、量刑建議制度層面的缺失、量刑建議實(shí)踐層面的不足、量刑建議說理機(jī)械僵化多數(shù)流于形式、量刑建議范圍狹隘等。如何完善量刑建議可以從觀念、制度以及實(shí)踐三個(gè)層面入手。
[Abstract]:The highest judicial organ of our country has reached a consensus on the procuratorial organ to carry out the sentencing suggestion work, and the sentencing suggestion has been determined as a specific litigation system in the criminal procedure. As an important content of the function of legal supervision, the procuratorial organ not only protects the litigant's right of litigation, but also supervises and restricts the sentencing judgment activity, which is helpful to ensure the fairness, justice and openness of sentencing activities. In the past two years, the system effect of sentencing suggestion has been effectively released to some extent, but there are still some problems, such as the concept obstacle of sentencing suggestion, the deficiency of sentencing suggestion system. The deficiency of sentencing suggestion in practice, the inflexibility of the mechanism of sentencing suggestion, the narrow range of sentencing suggestion and so on. How to perfect sentencing suggestion can start from three aspects: concept, system and practice.
