【摘要】：執(zhí)行難已成為影響我國司法權(quán)威的重要問題,也是人民群眾反映強烈、社會各界極為關注的熱點問題。由于我國整體上正處于社會主義初級階段,市場經(jīng)濟體制還不完善,法治理念還未深入人心等原因給人民法院的執(zhí)行工作帶來的難度越來越大。執(zhí)行難的原因有很多種,有我們國家體制和制度上的不完善,也有法院內(nèi)部的一些原因,盡管現(xiàn)在這個問題已經(jīng)引起各方面的關注和探索,但是如何能夠解決它還是擺在我們面前的一大難題。本文通過贊成反思法的思考方式對執(zhí)行難問題進行界定,并分析相關的原因等方面著手,提出了加強立法工作即制定強制執(zhí)行法,強化刑事立法,合理修改現(xiàn)行法律；完善現(xiàn)有的有關執(zhí)行工作的體制和體系,特別是執(zhí)行威懾機制的建設；另外認為改革是解決執(zhí)行難最為直接有效的方法,從人民法院的角度提出改革方案,并介紹本地區(qū)法院的優(yōu)秀做法,希望能對我們解決執(zhí)行難問題有所幫助。
[Abstract]:The difficulty of execution has become an important issue affecting the authority of our country's judicature. It is also a hot issue of the people's reflection and the great concern of all circles of the society. Because the market economy system is not perfect in the primary stage of socialism, the concept of the rule of law has not been deeply rooted in the people's court and the difficulty of the execution of the people's court. More and more. There are many reasons for the difficulties. There are many kinds of reasons in the system and system of our country. There are some reasons inside the court. Although this problem has attracted the attention and exploration of all aspects, how to solve it is a big problem in front of us. To define the difficult problem of execution and to analyze the related reasons, we have proposed to strengthen the legislative work, namely, to strengthen the legislative work, to strengthen the enforcement law, to strengthen the criminal legislation, to amend the current law reasonably, to improve the existing system and system of the relevant implementation work, especially to implement the construction of the deterrent system, and to think that the reform is the most difficult to solve the difficulties of execution. For the direct and effective method, the reform plan is put forward from the point of view of the people's court, and the excellent practice of the local district court is introduced. It is hoped that it can help us to solve the difficult problems.
