【摘要】：對于實施危害行為的精神障礙者如何處置,我國刑法僅在第十八條第一款做出原則性的規(guī)定,這是國家級立法對強制醫(yī)療問題的唯一一款規(guī)定,但在實踐過程中可操作性不強,這也說明了我國對強制醫(yī)療理論研究的嚴重不足。本文從強制醫(yī)療的概念出發(fā),敘述強制醫(yī)療在國內(nèi)外的發(fā)展進程,進而探討現(xiàn)階段爭議較大的問題:強制醫(yī)療的性質(zhì)和刑罰理論基礎(chǔ),然后結(jié)合相關(guān)刑法條文,探討我國強制醫(yī)療的現(xiàn)狀及存在的缺陷,最后對強制醫(yī)療如何完善提出建議。 強制醫(yī)療問題本身涉及刑法學、心理學、精神醫(yī)學、刑事政策學等相關(guān)學科知識。對精神障礙者的強制醫(yī)療,既需要從刑法理論和精神醫(yī)學理論上進行分析,也需要從立法上進行探討和完善。 全文約有三萬字,除引言外,主體分為五部分,框架如下: 引言。在本部分,從我國精神障礙者存在的數(shù)量及引發(fā)的社會問題出發(fā),結(jié)合馬加爵、邱興華等重大惡性刑事案件,引出實施危害行為精神障礙者應(yīng)當如何處遇。結(jié)合立法上的規(guī)定,提出應(yīng)對我國精神障礙者的強制醫(yī)療在理論上、立法上與實踐中存在的問題。 第一部分:強制醫(yī)療概述。在本部分,結(jié)合我國刑法第十八條第一款,對強制醫(yī)療的概念作出界定,認為強制醫(yī)療是指,強制已經(jīng)實施了危害社會的行為但無刑事責任能力的精神障礙者接受治療的一種強制性治療措施,并指出刑法條文中“精神病人”這一稱謂的不科學性。簡述國內(nèi)外精神障礙者強制醫(yī)療的發(fā)展過程。 第二部分:強制醫(yī)療的性質(zhì)和刑罰理論基礎(chǔ)。在本部分,簡介了關(guān)于強制醫(yī)療性質(zhì)的幾種爭議觀點,本文認為強制醫(yī)療是具有保安處分性質(zhì)的刑事法措施,并提出強制醫(yī)療的刑罰理論基礎(chǔ)是特殊預防理論。 第三部分:精神障礙者強制醫(yī)療的概況。在本部分,從強制醫(yī)療的法律依據(jù)出發(fā),包括地方性的規(guī)范,闡釋了我國現(xiàn)行強制醫(yī)療的適用對象及其判斷標準、適用的客觀要件是精神障礙者刑法所禁止的危害行為,其程序性要件的關(guān)鍵是司法精神醫(yī)學鑒定和司法判定,強制醫(yī)療的決定主體、期限與執(zhí)行場所等的現(xiàn)狀。 第四部分:精神障礙者強制醫(yī)療的缺陷和完善。在本部分,根據(jù)前述關(guān)于我國強制醫(yī)療的現(xiàn)狀,指出強制醫(yī)療在法定性、程序性、醫(yī)療模式、對象范圍等方面存在的缺陷,并提出在強制醫(yī)療的適用原則、立法、期限、方法、執(zhí)行場所、變更和終止、醫(yī)療模式等方面應(yīng)如何完善的建議。 第五部分:探討。在本部分就實踐中關(guān)于限制刑事責任能力的精神障礙者在兩種情況下的處遇問題進行了討論,并提出了意見。
[Abstract]:As to how to deal with persons with mental disorders who commit harmful acts, the criminal law of our country only stipulates in principle in the first paragraph of Article 18, which is the only provision of national legislation on compulsory medical treatment, but it is not feasible in practice. This also explains our country to the compulsory medical treatment theory research serious insufficiency. Starting from the concept of compulsory medical treatment, this paper describes the development process of compulsory medical treatment at home and abroad, and then discusses the controversial issues at present: the nature of compulsory medical treatment and the theoretical basis of penalty, and then combines the relevant articles of criminal law. This paper discusses the present situation and defects of compulsory medical treatment in China, and finally puts forward some suggestions on how to perfect compulsory medical treatment. Compulsory medical treatment itself involves knowledge of criminal law, psychology, psychiatry, criminal policy and so on. The compulsory medical treatment of mental disorders needs not only the analysis of the theory of criminal law and psychiatry, but also the exploration and perfection of legislation. In addition to the introduction, the main body is divided into five parts, the framework is as follows: Introduction In this part, starting from the number of mental disorders in China and the social problems caused by them, combining with the major criminal cases such as Ma Jia Jue and Qiu Xinghua, the author points out how to deal with the mental disorders who carry out harmful behavior. In combination with the legislative provisions, the problems in theory, legislation and practice of compulsory medical treatment for mental disorders in China are put forward. Part one: summary of compulsory medical treatment. In this part, combined with the first paragraph of Article 18 of the Criminal Law of our country, the concept of compulsory medical treatment is defined. It is a compulsory treatment measure for the mentally handicapped who have already carried out the behavior which endangers the society but has no criminal responsibility ability, and points out that the term "mental patient" in the articles of criminal law is unscientific. This paper briefly describes the development process of compulsory medical treatment for mental disorders at home and abroad. The second part: the nature of compulsory medical treatment and the theoretical basis of penalty. In this part, several controversial viewpoints about the nature of compulsory medical treatment are briefly introduced. The author holds that compulsory medical treatment is a criminal law measure with the nature of security measures, and puts forward that the theoretical basis of compulsory medical treatment is the theory of special prevention. The third part: the general situation of compulsory medical treatment for mental disorders. In this part, starting from the legal basis of compulsory medical treatment, including the local norms, the author explains the applicable object and the judgment standard of the current compulsory medical treatment in China. The objective elements of the application are the harmful acts prohibited by the criminal law of the mentally handicapped. The key points of its procedural requirements are the status quo of forensic psychiatry identification and judicial judgment, the determinant of compulsory medical treatment, the time limit and the place of execution. The fourth part: the limitation and perfection of compulsory medical treatment for mental disorders. In this part, according to the status quo of compulsory medical treatment in our country, the author points out the defects of compulsory medical treatment in legal qualification, procedure, medical model, object scope, and puts forward the applicable principle, legislation, time limit and method of compulsory medical treatment. Suggestions on how to improve the place of implementation, change and termination, medical model and so on. Part V: discussion. In this part, the author discusses the problems of mental disorders in two situations in practice, and puts forward some suggestions.
