【摘要】：法律監(jiān)督機關這一概念的理論淵源可追溯至列寧,列寧為蘇聯檢察制度實行垂直領導制和一般監(jiān)督奠定了基礎。中國檢察制度創(chuàng)建時在全面繼受蘇聯檢察制度的基礎上,產生了法律監(jiān)督機關概念。但是,在中國檢察制度放棄垂直領導制和一般監(jiān)督之后,法律監(jiān)督機關概念卻經歷了異化與重構的復雜過程。該概念在產生之初指實行垂直領導制和一般監(jiān)督的蘇式檢察機關,但在其法定化之后卻在否定垂直領導制和一般監(jiān)督的基礎上指維護國家法制統(tǒng)一的機關。法律監(jiān)督機關上述意義的轉變,標志著中國檢察制度擺脫蘇聯影響、走上獨立發(fā)展之路的同時,也為此后中國的立法與法學進一步豐富法律監(jiān)督機關概念的意義預留了空間。
[Abstract]:The theoretical origin of the concept of legal supervisory organ can be traced back to Lenin, who laid the foundation for the vertical leadership and general supervision of the Soviet procuratorial system. When China's procuratorial system was founded, the concept of legal supervisory organ was created on the basis of the Soviet Union's procuratorial system. However, after China's procuratorial system abandoned the vertical leadership system and general supervision, the concept of legal supervision organ experienced a complex process of alienation and reconstruction. At the beginning of its emergence, the concept refers to the Soviet procuratorial organ that implements vertical leadership system and general supervision, but after its legalization, it refers to the organ that maintains the unity of the national legal system on the basis of negating the vertical leadership system and general supervision. The change of the above-mentioned significance of the legal supervision organ marks the Chinese procuratorial system from the influence of the Soviet Union to take the road of independent development, but also for China's legislation and law to further enrich the meaning of the concept of legal supervision organs.
