【摘要】：涉訴信訪出現(xiàn)的時(shí)間不長,但產(chǎn)生的影響很大,很有研究的必要。當(dāng)前涉訴信訪形勢嚴(yán)峻,數(shù)量巨大且與日俱增,處理過程中引發(fā)的問題很多,影響到社會(huì)的穩(wěn)定和國家制度的正常運(yùn)轉(zhuǎn)。研究涉訴信訪將會(huì)對(duì)以后解決問題起到至關(guān)重要的作用。筆者試圖從國家意志方而、司法層面以及傳統(tǒng)文化的某些因素來分析涉訴信訪的成因�？偟膩砜�,涉訴信訪的成因多種多樣,非常復(fù)雜,但抓住了這點(diǎn),就找準(zhǔn)了矛盾的主要方面。 就國家意志而言,雖然有某些禁止性規(guī)定,甚至默許特殊場合下地方黨委、政府對(duì)涉訴信訪人的打壓,但從國家信訪制度設(shè)置、法治工具性價(jià)值定位、人治習(xí)慣的大量存在、政治架構(gòu)以及法律機(jī)制等方面來看,在當(dāng)前環(huán)境下,涉訴信訪的產(chǎn)生和大量存在是不可避免的,是現(xiàn)有政策下的必然產(chǎn)物。就司法層面來看,司法制度設(shè)計(jì)不科學(xué),地方化十分嚴(yán)重,當(dāng)事人為自救,選擇繞開地方,向上進(jìn)行涉訴信訪是不得已而又有效的選擇；法院近年來不甘居后,加大改革力度,力爭在各方面有所突破,但改革中存在不少問題,涉訴信訪成為其改革失敗的產(chǎn)物；另外,多年來司法運(yùn)行中出現(xiàn)的不良現(xiàn)象經(jīng)沉淀發(fā)酵,加上媒體的不適當(dāng)放大,導(dǎo)致司法公信力低下,與涉訴信訪形成惡性循環(huán)。就傳統(tǒng)文化而言,上告文化讓人對(duì)涉訴信訪難以割舍,而超強(qiáng)能力的傳統(tǒng)文化又讓人對(duì)涉訴信訪不能放棄：另外,從傳統(tǒng)文化發(fā)展而來的法律虛無主義和宗教信仰虛無主義,也對(duì)涉訴信訪的產(chǎn)生起到了推波助瀾的作用。 涉訴信訪的弊端主要表現(xiàn)在：使社會(huì)喪失了糾紛解決的權(quán)威仲裁者,浪費(fèi)了大量社會(huì)資源,以及實(shí)效性差、效率低三個(gè)方面。針對(duì)涉訴信訪的成因和弊端,應(yīng)進(jìn)一步探討有效應(yīng)對(duì)的方法,通過努力在一定程度上限制涉訴信訪負(fù)面作用的發(fā)揮。最后,通過比對(duì)、分析,可以預(yù)見涉訴信訪在一段時(shí)問內(nèi)還是有市場和生存空間的,但長久來看,其走向消亡或變種是不可避免的。
[Abstract]:The time of petition is not long, but the influence is very big, it is necessary to study. At present, the situation of complaint letters and visits is severe, the number is huge and increasing day by day, and many problems are caused in the process of handling, which affect the social stability and the normal operation of the state system. The research on complaint petition will play an important role in solving the problem in the future. The author tries to analyze the causes of petition from the aspect of national will, judicial level and some factors of traditional culture. On the whole, the causes of complaint petition are various and very complicated, but if we grasp this point, we will find out the main aspects of contradiction. As far as the national will is concerned, although there are certain prohibitive provisions, even acquiescing in the suppression of local party committees and governments on special occasions, but from the establishment of the national petition system, the value orientation of the rule of law as a tool, and the existence of a large number of people's rule of law habits, From the point of view of political structure and legal mechanism, under the current environment, it is inevitable to produce and exist a large number of complaint letters and visits, which is the inevitable outcome of the existing policies. At the judicial level, the design of the judicial system is unscientific and the localization is very serious. In order to save oneself, it is necessary and effective for the parties concerned to choose to bypass the place and to carry out complaints and visits upwards. In recent years, the court has been unwilling to live in the country, and has intensified its reform efforts. We strive to make breakthroughs in various fields, but there are many problems in the reform, and complaints, petitions and visits have become the product of its failed reform. In addition, the undesirable phenomena that have emerged in the course of many years of judicial operation have been precipitated and fermented, coupled with improper media amplification. It leads to the low credibility of the judiciary and forms a vicious circle with the petition. As far as the traditional culture is concerned, the petition culture makes it difficult for people to give up the petition, and the super strong traditional culture can not give up the petition. In addition, the legal nihilism and the religious belief nihilism developed from the traditional culture can not be abandoned. It also contributes to the emergence of complaint letters and visits. The malpractice of petition is mainly manifested in three aspects: the loss of the authoritative arbiter of dispute resolution, the waste of a large number of social resources, and the ineffectiveness and inefficiency of the society. In view of the causes and disadvantages of complaint petition, it is necessary to further explore the effective ways to deal with it, and to limit the negative effect of complaint petition to a certain extent. Finally, through comparison and analysis, we can foresee that there is still market and living space in a certain period of time, but in the long run, its trend of extinction or variety is inevitable.
