【摘要】:1980年,我國(guó)恢復(fù)了律師制度。我國(guó)的律師業(yè)經(jīng)過(guò)三十多年的發(fā)展,業(yè)務(wù)能力、管理體制、管理水平都取得了巨大進(jìn)步,從業(yè)律所的規(guī)模和律師素質(zhì)得到了較大提高,律師業(yè)面貌整體煥然一新,在全社會(huì)取得了較好聲譽(yù)。但是,從世界律師行業(yè)的發(fā)展現(xiàn)狀來(lái)看,特別是以發(fā)達(dá)國(guó)家的標(biāo)準(zhǔn)來(lái)看,我國(guó)律師業(yè)的發(fā)展還處于初級(jí)階段。特別是加入世貿(mào)組織后,更需要我國(guó)形成一批專業(yè)化強(qiáng)、規(guī)模層次高、業(yè)務(wù)能力強(qiáng)的一流律師事務(wù)所,否則將無(wú)法與實(shí)力雄厚的外國(guó)律師事務(wù)所抗衡,為社會(huì)主義事業(yè)提供強(qiáng)有力的法律支持也將成為一句空話。嚴(yán)峻的現(xiàn)實(shí)表明,必須改進(jìn)工作方法、完善考評(píng)機(jī)制,進(jìn)一步激發(fā)律師事務(wù)所工作人員的工作熱情和工作積極性,使律師事務(wù)所朝著科學(xué)化、規(guī)范化的方向不斷前進(jìn)。為了實(shí)現(xiàn)這個(gè)目標(biāo),從制度上、根本上使律師事務(wù)所迸發(fā)出無(wú)窮活力,我們要根據(jù)行業(yè)發(fā)展的方向和重點(diǎn),有計(jì)劃、有針對(duì)性地對(duì)律師事務(wù)所的考評(píng)機(jī)制進(jìn)行一次全面的調(diào)查研究,查找出存在的問(wèn)題,確定出既切合實(shí)際又特色鮮明的考核辦法,從而為律師事務(wù)所行業(yè)帶來(lái)新的生機(jī)和活力。 本文以L律師事務(wù)所為例,對(duì)律師事務(wù)所績(jī)效考核方案進(jìn)行研究和再設(shè)計(jì)。主要包括概述律師事務(wù)所績(jī)效考核現(xiàn)狀、分析考核存在的缺陷和不足、闡述對(duì)考核方案進(jìn)行改進(jìn)的意義、提出對(duì)考核體系進(jìn)行再優(yōu)化后的方案。其中,對(duì)考核體系的再優(yōu)化是本文的重點(diǎn)。在這一章里,通過(guò)論述績(jī)效考核的原則和思路,對(duì)被考核對(duì)象進(jìn)行調(diào)查,得出被考核對(duì)象對(duì)考核的意見(jiàn)建議,然后優(yōu)化考核方案,展示優(yōu)化后方案的應(yīng)用方法和預(yù)期效果。 本文通過(guò)對(duì)律師事務(wù)所績(jī)效考核方面的概括性研究,對(duì)其進(jìn)行了績(jī)效考核方案的優(yōu)化設(shè)計(jì)。設(shè)立了科學(xué)合理的評(píng)估標(biāo)準(zhǔn)。將評(píng)估依據(jù)設(shè)計(jì)得標(biāo)準(zhǔn)全面,關(guān)鍵的標(biāo)準(zhǔn)有連續(xù)性、可量化、體現(xiàn)整體性;評(píng)估過(guò)程較為完整;提高了員工對(duì)考評(píng)的信服度,以期為律師事務(wù)所考核體系的不斷完善和規(guī)范提供一些借鑒和啟示。
[Abstract]:In 1980, our country restored the lawyer system. After more than 30 years of development, the legal profession in our country has made great progress in terms of its professional ability, management system and management level. The scale and quality of the legal firms have been greatly improved, and the overall face of the legal profession has taken on a completely new look. It has gained a good reputation in the whole society. However, judging from the current situation of the world's lawyer industry, especially by the standards of the developed countries, the development of our country's lawyer industry is still in the primary stage. Especially after China's accession to the WTO, it is even more necessary for our country to form a number of first-class law firms with strong specialization, high level of scale, and strong business capability. Otherwise, they will not be able to compete with strong foreign law firms. To provide strong legal support for the cause of socialism will also be empty talk. The austere reality shows that it is necessary to improve the working methods, perfect the examination and evaluation mechanism, further stimulate the work enthusiasm and enthusiasm of the staff of the law firms, and make the law firms move toward the direction of science and standardization. In order to achieve this goal, the law firms are fundamentally energized by the system. We must plan according to the direction and focus of the development of the industry. This paper makes a comprehensive investigation and study on the examination and evaluation mechanism of law firms, finds out the existing problems, and determines the examination methods which are both practical and distinctive, thus bringing new vigor and vitality to the law firm industry. This paper takes L law firm as an example to study and redesign the performance appraisal scheme of law firm. It mainly includes summarizing the present situation of the performance appraisal of the law firm, analyzing the defects and shortcomings of the appraisal, expounding the significance of improving the examination scheme, and putting forward the plan after the re-optimization of the appraisal system. Among them, the re-optimization of the assessment system is the focus of this paper. In this chapter, through discussing the principle and train of thought of performance appraisal, the author investigates the object under examination, and draws the opinion and suggestion of the subject, then optimizes the evaluation scheme, and shows the application method and expected effect of the optimized scheme. Based on the general research on the performance appraisal of law firms, the optimization design of the performance appraisal scheme is carried out in this paper. Scientific and reasonable evaluation criteria have been established. The evaluation will be based on the design criteria comprehensive, the key criteria have continuity, quantifiable, reflect integrity; the evaluation process is relatively complete; improve the staff's confidence in the evaluation, In order to continue to improve and standardize the examination system of law firms to provide some reference and inspiration.
