【摘要】：監(jiān)獄作為國(guó)家的刑罰執(zhí)行機(jī)關(guān),通過(guò)監(jiān)禁的形式實(shí)現(xiàn)對(duì)罪犯的懲罰功能。罪犯投入監(jiān)獄,其矛盾與沖突就必然存在,這些矛盾一旦激化,就會(huì)引發(fā)各類(lèi)監(jiān)管安全事故。由此,監(jiān)獄從其誕生之日起就一直伴隨著是否安全的問(wèn)題。世界各國(guó),無(wú)論古今中外,也無(wú)論其社會(huì)制度、生活方式、文化背景、意識(shí)形態(tài)如何差異,都始終重視維護(hù)監(jiān)獄的安全穩(wěn)定。在中國(guó),隨著當(dāng)前監(jiān)管安全形勢(shì)的變化,監(jiān)獄內(nèi)關(guān)押的十年以上的重刑犯、暴力犯、二次以上犯罪的罪犯與團(tuán)伙犯持續(xù)增加,呈現(xiàn)逐年上升的趨勢(shì),并已經(jīng)成為監(jiān)獄押犯的主體,給監(jiān)獄的監(jiān)管安全工作帶來(lái)更大的壓力和挑戰(zhàn)。 本文除緒論外,主要包括四部分:一是維護(hù)監(jiān)獄監(jiān)管安全之價(jià)值及功能;二是監(jiān)獄監(jiān)管安全機(jī)制之一般原理;三是監(jiān)獄監(jiān)管安全機(jī)制建設(shè);四是當(dāng)前監(jiān)獄監(jiān)管安全機(jī)制之完善與運(yùn)行。
[Abstract]:As the state's penalty enforcement organ, the prison realizes the punishment function of the criminal through the form of imprisonment. If criminals are put into prison, their contradictions and conflicts will inevitably exist. Once these contradictions are intensified, they will lead to all kinds of supervisory safety accidents. As a result, the prison has been accompanied by the issue of safety since its birth. Countries all over the world, regardless of their social systems, lifestyles, cultural backgrounds and ideological differences, have always attached importance to maintaining the security and stability of prisons. In China, with the change of the current supervision and security situation, the number of heavy criminals, violent criminals, criminals and gang criminals held in prisons for more than 10 years has been increasing continuously, showing a rising trend year by year. And has become the main prison prisoners, prison supervision and security brought greater pressure and challenges. In addition to the introduction, this paper mainly includes four parts: one is to maintain the value and function of prison supervision security, the second is the general principle of prison supervision security mechanism, the third is the construction of prison supervision security mechanism; Fourth, the improvement and operation of the current prison supervision and security mechanism.
