論輿論監(jiān)督與司法獨立的關系

【摘要】:輿論監(jiān)督指的是社會公眾通過一定的形式,發(fā)表意見和建議,對涉及公共事務的組織和個人實行的檢查和督促的活動。輿論監(jiān)督的權利是公民知情權,表達自由的體現(xiàn),社會公眾有權對社會事務、國家權力的運行進行監(jiān)督。司法權是國家公權力的一種,公眾輿論對司法權的運行進行監(jiān)督,對促進司法公正,防止司法腐敗有著重要作用。輿論監(jiān)督和司法獨立在促進社會公平正義這一點上是一致的,二者的本應是相互協(xié)調,相互促進的關系。但是,司法獨立要求司法權在一個相對獨立的環(huán)境內運行,司法權的運行排斥任何不合法、不合程序的介入,輿論監(jiān)督與司法獨立在事實認定標準、立場和出發(fā)點等方面的差異使二者存在沖突的可能。在我國,由于輿論監(jiān)督和司法體制的不完善,加上網絡等輿論監(jiān)督形式的復雜多變等原因的影響,使輿論監(jiān)督與司法獨立的沖突多有發(fā)生,輿論監(jiān)督與司法獨立之間的合理界限并未確立。本文分三個部分對輿論監(jiān)督與司法獨立的關系進行論述:第一部分闡述了輿論監(jiān)督和司法獨立的概念,闡明了輿論監(jiān)督并不等于新聞監(jiān)督,新聞監(jiān)督只是輿論監(jiān)督的形式之一,在我國,司法獨立并不包括法官獨立而僅僅是人民法院的審判獨立,論述了輿論監(jiān)督與司法獨立應然的協(xié)調關系,輿論監(jiān)督有其正當的權利基礎,而且輿論監(jiān)督與司法獨立在追求社會公平正義這一點上是一致的;第二部分闡述了我國輿論監(jiān)督與司法獨立沖突的表現(xiàn),從輿論監(jiān)督與司法活動特征的差異性以及司法體制和輿論監(jiān)督自身的不完善等方吾具體分析了二者產生沖突的原因;第三部分針對我國現(xiàn)實,提出了協(xié)調我國輿論監(jiān)督與司法獨立關系的建議,通過不斷的理論探討和實踐摸索實現(xiàn)二者之間的良性互動,推動我國民主法治社會的建設。
[Abstract]:Public opinion supervision refers to the inspection and supervision of organizations and individuals involved in public affairs through certain forms of public opinion and suggestions. The right of public opinion supervision is the embodiment of citizens' right to know and freedom of expression, and the public has the right to supervise the operation of social affairs and state power. Judicial power is a kind of national public power. Public opinion supervises the operation of judicial power, which plays an important role in promoting judicial justice and preventing judicial corruption. The supervision of public opinion and the independence of the judiciary are consistent in promoting social fairness and justice, and their relationship should be coordinated and mutually promoted. However, judicial independence requires the judicial power to operate in a relatively independent environment. The operation of the judicial power excludes any illegal and non-procedural intervention, and the supervision of public opinion and the independence of the judiciary are found to be standard in fact. The differences of standpoint and starting point make it possible for them to conflict. In China, because of the imperfect public opinion supervision and judicial system, and the influence of the complex and changeable forms of public opinion supervision, such as the Internet, conflicts between public opinion supervision and judicial independence often occur. The reasonable boundary between public opinion supervision and judicial independence has not been established. This paper discusses the relationship between public opinion supervision and judicial independence in three parts: the first part expounds the concept of public opinion supervision and judicial independence, and clarifies that public opinion supervision is not equal to news supervision, and news supervision is only one of the forms of public opinion supervision. In China, judicial independence does not include the independence of judges but only the judicial independence of the people's court. This paper discusses the harmonious relationship between the supervision of public opinion and the independence of the judiciary, and the supervision of public opinion has its legitimate right basis. Moreover, the supervision of public opinion and the independence of the judiciary are consistent in the pursuit of social fairness and justice. The second part expounds the manifestation of the conflict between the supervision of public opinion and the independence of the judiciary. From the differences between the characteristics of public opinion supervision and judicial activities and the imperfections of the judicial system and the supervision of public opinion itself, the author analyzes the causes of the conflict between the two. The third part is aimed at the reality of our country. This paper puts forward some suggestions to coordinate the relationship between the supervision of public opinion and the independence of judicature in our country. Through the constant theoretical discussion and practice, we can realize the benign interaction between the two and promote the construction of a democratic society under the rule of law in our country.
