【摘要】：山東省D監(jiān)獄作為山東省監(jiān)獄系統(tǒng)一個(gè)以煤炭能源為監(jiān)獄企業(yè)支柱的,以煤炭生產(chǎn)衍生勞動(dòng)崗位為監(jiān)獄罪犯勞動(dòng)改造提供崗位的監(jiān)獄,目前正面臨著監(jiān)獄布局調(diào)整,監(jiān)獄體制改革,監(jiān)獄退危的多重考驗(yàn)。本文立足于此大背景下的山東省D監(jiān)獄罪犯管理工作實(shí)際,通過(guò)對(duì)近幾年山東省D監(jiān)獄罪犯管理工作的調(diào)查研究,綜合調(diào)查問(wèn)卷、訪談、查閱數(shù)據(jù)等方法,運(yùn)用公共管理學(xué)、公共治理理論、監(jiān)獄學(xué)等方面的理論知識(shí),從罪犯管理的職能法規(guī)、罪犯管理的手段以及罪犯管理的主體三大方面入手,選取監(jiān)獄職能、罪犯獄政改造、勞動(dòng)改造、教育改造、監(jiān)獄警察隊(duì)伍建設(shè)等角度對(duì)改革退危轉(zhuǎn)型下山東省D監(jiān)獄罪管理工作進(jìn)行剖析研究,具體分析了監(jiān)企合一的體制模式對(duì)監(jiān)獄職能影響,以煤礦生產(chǎn)為主的勞動(dòng)改造模式對(duì)罪犯的分類處遇制度的制約,監(jiān)獄的退危轉(zhuǎn)型搬遷對(duì)于罪犯的勞動(dòng)改造目標(biāo)的動(dòng)搖,傳統(tǒng)教育改造觀念的持續(xù)根深蒂固,監(jiān)獄警察隊(duì)伍建設(shè)不夠完善。針對(duì)問(wèn)題的成因提出作者有的放矢基于協(xié)同治理角度從罪犯的管理職能法規(guī)方面提出要加快監(jiān)獄改革推進(jìn)步伐、完善立法,罪犯管理的手段方面提出要強(qiáng)化獄政改造職能建設(shè)、創(chuàng)新教育改造內(nèi)容、打造科學(xué)的罪犯勞動(dòng)改造體系、罪犯管理的主體方面要深化監(jiān)獄人民警察隊(duì)伍建設(shè)。這些建議的提出可以對(duì)提高監(jiān)獄管理罪犯水平、強(qiáng)化罪犯改造、規(guī)范監(jiān)獄警察執(zhí)法、理順監(jiān)獄與其企業(yè)的關(guān)系、保障監(jiān)獄警察和罪犯的合法權(quán)益具有一定的指導(dǎo)意義,同時(shí),也可以為省內(nèi)其他監(jiān)獄的退危形勢(shì)下的罪犯管理工作提供一定的借鑒。
[Abstract]:As a prison in Shandong Province, where coal energy is the mainstay of prison enterprises and jobs derived from coal production provide posts for prison criminals' re-education through labor, Shandong D prison is now facing a readjustment of the prison layout. The reform of the prison system and the repeated test of the prison's retreat from danger. Based on the actual situation of the criminal management in Shandong D prison under this background, this paper makes use of the methods of public management, such as investigation and research on the management of D prison criminals in Shandong Province in recent years, comprehensive investigation questionnaire, interview, data access and so on. Public governance theory, prison science and other theoretical knowledge, from the criminal management of the functional laws and regulations, the means of criminal management and criminal management of the main body of three major aspects of the selection of prison functions, prison reform, reform through labour, education reform, From the point of view of the construction of prison police force, this paper analyzes and studies the crime management work of D prison in Shandong Province under the transformation of reform and retreat, and concretely analyzes the influence of the system model of the integration of prison and enterprise on the prison function. The labor reform mode, which is based on coal mine production, restricts the classification and treatment of criminals, vacillates the target of reeducation through labour for criminals due to the transition and relocation of prisons, and the persistence of traditional education and reform concept. The construction of prison police force is not perfect enough. In view of the causes of the problem, the author puts forward that from the angle of cooperative governance, the author should accelerate the pace of prison reform, perfect the legislation, strengthen the construction of the prison administration reform function from the point of view of the criminal management function law, improve the legislation, and strengthen the construction of the prison administration reform function. We should innovate the contents of education and reform, create a scientific system of reforming criminals through labor, and deepen the construction of the prison people's police force in the main body of criminal management. These suggestions can improve the level of prison management criminals, strengthen the reform of criminals, standardize the law enforcement of prison police, straighten out the relationship between prisons and their enterprises, and protect the legitimate rights and interests of prison police and criminals. At the same time, It can also provide some reference for the management of criminals in other prisons in the province.
