【摘要】：近些年，，隨著我國民主化進(jìn)程的不斷推進(jìn)，輿論監(jiān)督在促進(jìn)司法公正方面起到了積極的推動作用。但隨著媒體活力和影響力的不斷增強(qiáng)，輿論與司法之間的沖突也在不斷增多。由于媒體與司法維護(hù)社會正義的最終目標(biāo)是一致的，所以兩者的矛盾與沖突通過一定的方式可以得到調(diào)節(jié)，最終變成相互促進(jìn)的動力。 本文分四個(gè)部分，第一部分介紹了輿論、輿論監(jiān)督、司法和司法公正等相關(guān)概念，并對輿論與司法的關(guān)系進(jìn)行了初步的討論；第二部分著重分析了輿論監(jiān)督對司法獨(dú)立、輿論監(jiān)督對司法公開的影響及意義；第三部分討論了輿論監(jiān)督與司法公正沖突的成因及表現(xiàn)方式；第四部分從我國的實(shí)際出發(fā)，積極探索形成輿論監(jiān)督與司法公正良性關(guān)系的途徑，就如何化解雙方的沖突、攜手共同維護(hù)社會公平和正義提出了幾點(diǎn)看法。 我國現(xiàn)階段無論大眾傳媒還是司法系統(tǒng)都還不夠完善，都需要我們社會的保護(hù)，不能有所偏頗。應(yīng)該采取措施妥善協(xié)調(diào)輿論監(jiān)督與司法公正間的關(guān)系，使其攜手共進(jìn)，平衡發(fā)展，相互促進(jìn)，保障司法公正，積極推動我國的民主與法治建設(shè)。
[Abstract]:In recent years, with the continuous progress of democratization in China, public opinion supervision has played a positive role in promoting judicial justice. However, with the increasing vitality and influence of the media, the conflict between public opinion and justice is also increasing. Because the ultimate goal of media and judicature to maintain social justice is the same, the contradiction and conflict between them can be adjusted in a certain way, and finally become the motive force of mutual promotion. This paper is divided into four parts. The first part introduces the concepts of public opinion, supervision of public opinion, judicature and judicial justice, and discusses the relationship between public opinion and judicature. The third part discusses the causes and manifestations of the conflict between public opinion supervision and judicial justice. The fourth part starts from the reality of our country. This paper explores the ways to form a benign relationship between public opinion supervision and judicial justice, and puts forward some views on how to resolve the conflicts between the two sides and join hands to safeguard social fairness and justice. At present, both mass media and judicial system are not perfect in our country, they all need the protection of our society and can not be biased. Measures should be taken to properly coordinate the relationship between public opinion supervision and judicial justice, to make them advance hand in hand, to balance their development, to promote each other, to guarantee judicial justice, and to actively promote the construction of democracy and the rule of law in our country.
