【摘要】：我國《憲法》明確規(guī)定檢察機關(guān)是我國的法律監(jiān)督機關(guān),檢察官則是法律的監(jiān)督者,通過檢察官辦理具體案件以及行使檢察權(quán)等司法活動來履行檢察機關(guān)的法定職責。檢察官作為維護國家法律正確實施的重要參與者,其職業(yè)道德素質(zhì)狀況將對確保檢察官秉公執(zhí)法,樹立檢察機關(guān)良好形象以及維護社會的公平正義有重要影響。然而,我國以往在檢察官的培養(yǎng)問題上過于關(guān)注其專業(yè)素質(zhì),而對檢察官職業(yè)道德素質(zhì)的培養(yǎng)重視不夠,從而影響優(yōu)質(zhì)檢察官隊伍的培養(yǎng)。近年來,隨著司法改革的深入推進,各級檢察機關(guān)開始逐漸把注意力投向檢察官職業(yè)道德建設(shè),這使我國的檢察官職業(yè)道德素質(zhì)得到一定的提升。但是由于我國檢察官職業(yè)道德培養(yǎng)的先期不足、任期期間的職業(yè)道德素質(zhì)培養(yǎng)存在一定弊端以及職業(yè)道德素質(zhì)培養(yǎng)的配套機制不健全等原因,我國檢察官職業(yè)道德素質(zhì)的現(xiàn)狀與建設(shè)社會主義法治國家對檢察機關(guān)的要求仍然有一定差距。因此加強檢察官職業(yè)道德素質(zhì)培養(yǎng),提高檢察官職業(yè)道德素質(zhì)整體水平是當前我國司法改革十分重要的命題。檢察官職業(yè)道德素質(zhì)不僅是檢察官堅守職業(yè)底線的重要前提,也是檢察官完成法定監(jiān)督職責的重要保障。本文正文第一章首先對檢察官職業(yè)道德素質(zhì)的含義和檢察官職業(yè)道德素質(zhì)的特征進行闡述,然后從依法行使檢察權(quán)、樹立良好職業(yè)形象和提高司法公信力等三方面闡述檢察官職業(yè)道德素質(zhì)培養(yǎng)的價值取向,最后分析了檢察官職業(yè)道德素質(zhì)培養(yǎng)的影響因素,包括家庭因素、學(xué)校因素、社會因素和經(jīng)濟因素。第二章主要分析了檢察官職業(yè)道德素質(zhì)培養(yǎng)的形式與內(nèi)容。形式上主要有三種,任職前的學(xué)校培養(yǎng)、檢察官任職期間的經(jīng)常性培養(yǎng)以及檢察官自我修養(yǎng)。內(nèi)容主要概括為忠誠、為民、擔當、公正、廉潔等五方面。第三章主要通過對我國檢察官職業(yè)道德素質(zhì)培養(yǎng)的現(xiàn)狀進行分析,首先指出我國檢察官職業(yè)道德素質(zhì)培養(yǎng)的問題,主要存在四個方面的問題,即檢察官職業(yè)道德素質(zhì)的先期培養(yǎng)不足,檢察官任職期間職業(yè)道德素質(zhì)培養(yǎng)存在一定弊端,檢察官自我修養(yǎng)不足以及檢察官職業(yè)道德素質(zhì)培養(yǎng)的配套機制不夠健全,其后具體分析配套機制不夠健全的三個方面,包括選任機制不完善、檢察官職業(yè)待遇不合理以及檢察官獎懲制度不夠完善。第四章針對上述問題,在立足于中國國情的基礎(chǔ)上,對完善檢察官職業(yè)道德素質(zhì)培養(yǎng)的方法進行探討,提出加強檢察官職業(yè)道德素質(zhì)的先期培養(yǎng),完善檢察官任職期間職業(yè)道德素質(zhì)培養(yǎng),建立健全檢察官職業(yè)道德素質(zhì)培養(yǎng)的選任機制、職業(yè)待遇、獎懲制度等配套機制,從而提升檢察官職業(yè)道德素質(zhì),為我國建設(shè)社會主義法治國家保駕護航。
[Abstract]:The Constitution of our country clearly stipulates that the procuratorial organ is the legal supervisory organ of our country, and the procurator is the supervisor of the law. The procurator handles specific cases and exercises procuratorial power and other judicial activities to fulfill the legal duties of the procuratorial organ. As an important participant in safeguarding the correct implementation of national laws, the professional ethics quality of prosecutors will have an important impact on ensuring that procurators enforce the law impartially, establishing a good image of procuratorial organs and safeguarding the fairness and justice of the society. However, in the past, our country paid too much attention to the professional quality of prosecutors, but not paid enough attention to the cultivation of professional ethics of prosecutors, thus affecting the cultivation of high-quality prosecutors. In recent years, with the deepening of judicial reform, procuratorial organs at all levels began to pay attention to the construction of prosecutors' professional ethics. However, due to the shortage of professional ethics cultivation in our country, there are some drawbacks in the training of professional ethics quality during the tenure of office, and the supporting mechanism for the training of professional ethics quality is not perfect. There is still a gap between the present situation of the professional ethics quality of public procurators in China and the requirements of procuratorial organs in building a socialist country ruled by law. Therefore, it is very important to strengthen the cultivation of procurator's professional ethics and improve the whole level of procurator's professional ethics. The quality of prosecutors' professional ethics is not only an important prerequisite for prosecutors to adhere to the professional bottom line, but also an important guarantee for prosecutors to fulfill their statutory supervision duties. In the first chapter of this paper, the meaning of the professional ethics quality of the procurator and the characteristics of the professional ethics quality of the procurator are expounded, and then the procuratorial power is exercised according to the law. This paper sets up a good professional image and raises the judicial credibility and expounds the value orientation of the training of the procurator's professional ethics quality. Finally, it analyzes the influencing factors of the public procurator's professional ethics quality training, including the family factor, the school factor, and so on. Social and economic factors The second chapter mainly analyzes the form and content of professional ethics cultivation of prosecutors. There are mainly three types of formal, pre-service school training, the regular training of prosecutors during their tenure and prosecutors self-cultivation. The content is mainly summarized as loyalty, for the people, responsibility, justice, clean and so on five aspects. The third chapter mainly through the analysis of the current situation of our country prosecutor professional ethics quality cultivation, first points out our country procurator professional ethics quality cultivation question, mainly exists four aspects questions, That is to say, there are some defects in the training of the professional ethics quality of the procurators, the deficiency of the self-cultivation of the procurators and the imperfect supporting mechanism of the training of the professional ethics qualities of the procurators. Then it analyzes three aspects that the supporting mechanism is not perfect, including the imperfect selection mechanism, the unreasonable professional treatment of the procurators and the imperfect system of rewards and punishments of the procurators. The fourth chapter aims at the above problems, on the basis of China's national conditions, discusses the methods to improve the quality of prosecutors' professional ethics, and proposes to strengthen the advance cultivation of prosecutors' professional ethics quality. To improve the quality of public procurators' professional ethics during their term of office, to establish and improve the mechanism of selection, treatment, reward and punishment, and so on, in order to improve the professional ethics of prosecutors, and to improve the quality of public procurators' professional ethics. To build a socialist country ruled by law to protect our country.
