【摘要】：職務(wù)犯罪是指國(guó)家公職人員利用職權(quán)或者違背職責(zé),侵犯國(guó)家機(jī)關(guān)正�；顒�(dòng)秩序,致使國(guó)家和人民的利益遭受重大損失,依照國(guó)家法律應(yīng)當(dāng)受到刑罰處罰的行為的總稱。職務(wù)犯罪偵查作為有效遏制職務(wù)犯罪的重要手段,在當(dāng)前反腐倡廉之大勢(shì)下,備受社會(huì)關(guān)注,也是學(xué)術(shù)界與司法實(shí)務(wù)界研究的一個(gè)熱點(diǎn)。通過(guò)正確有效的行使職務(wù)犯罪偵查權(quán),以權(quán)力制約權(quán)力,不僅可以保證國(guó)家工作人員正確行使職權(quán),更重要的是可以實(shí)現(xiàn)對(duì)權(quán)力的法律監(jiān)督。職務(wù)犯罪偵查權(quán)的配置,就是指職務(wù)犯罪偵查權(quán)的配備與安排。目前,我國(guó)的職務(wù)犯罪偵查權(quán)由檢察機(jī)關(guān)單獨(dú)行使,其內(nèi)部的配置模式則出現(xiàn)了分化,部分地區(qū)進(jìn)行了一體化機(jī)制建設(shè)的有益嘗試。對(duì)于目前的這種配置模式,無(wú)論是學(xué)術(shù)界還是實(shí)務(wù)界,都出現(xiàn)了一些不同的聲音。 本文通過(guò)域外考察,借鑒國(guó)外職務(wù)犯罪偵查權(quán)配置的有益經(jīng)驗(yàn),以及回顧歷史,梳理發(fā)展脈絡(luò),對(duì)我國(guó)職務(wù)犯罪偵查權(quán)的配置進(jìn)行了一定的思考：認(rèn)為由檢察機(jī)關(guān)行使職務(wù)犯罪偵查權(quán)是適宜的,是符合我國(guó)具體國(guó)情的,同時(shí),在檢察機(jī)關(guān)內(nèi)部,整合所有行使職務(wù)犯罪偵查權(quán)的部門(mén),進(jìn)行一體化機(jī)制建設(shè),是今后職務(wù)犯罪偵查工作發(fā)展的方向。 全文共分為三個(gè)部分,文章第一部分是職務(wù)犯罪偵查權(quán)的配置概述。開(kāi)篇先界定了“職務(wù)犯罪”、“職務(wù)犯罪偵查權(quán)”、“職務(wù)犯罪偵查權(quán)的配置”等基本概念,繼而對(duì)職務(wù)犯罪偵查權(quán)的性質(zhì)進(jìn)行了具體分析。對(duì)于職務(wù)犯罪偵查權(quán)的性質(zhì),當(dāng)前理論界和司法實(shí)務(wù)部門(mén)主要有以下幾種認(rèn)識(shí)：司法權(quán)說(shuō)；行政權(quán)說(shuō)；司法權(quán)行政權(quán)雙重性質(zhì)說(shuō)；法律監(jiān)督權(quán)說(shuō)。本文通過(guò)厘清權(quán)力的外部特征與本質(zhì)屬性,認(rèn)為職務(wù)犯罪偵查權(quán)究其性質(zhì),是形式上具有行政權(quán)某些特征的法律監(jiān)督權(quán)。 第二部分論述了檢察機(jī)關(guān)行使職務(wù)犯罪偵查權(quán)的依據(jù)。首先,通過(guò)域外考察,比較和研究了國(guó)外職務(wù)犯罪偵查權(quán)配置的幾種模式,并總結(jié)歸納出域外職務(wù)犯罪偵查權(quán)配置模式的相關(guān)特點(diǎn)。其次,回顧歷史,對(duì)我國(guó)職務(wù)犯罪偵查權(quán)配置的發(fā)展脈絡(luò)進(jìn)行梳理,并介紹了目前的現(xiàn)狀。最后,通過(guò)分別論述我國(guó)職務(wù)犯罪偵查權(quán)配置的四種模式,并分析各自的利弊,提出了本文的觀點(diǎn),即由檢察機(jī)關(guān)行使職務(wù)犯罪偵查權(quán)是適宜的。 第三部分對(duì)職務(wù)犯罪偵查權(quán)的內(nèi)部配置問(wèn)題進(jìn)行了闡述。首先,梳理了檢察機(jī)關(guān)內(nèi)部,職務(wù)犯罪偵查機(jī)構(gòu)設(shè)置及變更的歷史沿革,并簡(jiǎn)要列舉了目前我國(guó)檢察機(jī)關(guān)的部門(mén)與職權(quán)設(shè)置。緊接著,本文提出了職務(wù)犯罪偵查權(quán)內(nèi)部配置的基本構(gòu)想,即實(shí)施職務(wù)犯罪偵查一體化機(jī)制建設(shè),建立集中型職務(wù)犯罪偵查體制。此外,還要努力實(shí)現(xiàn)檢察機(jī)關(guān)內(nèi)部的“檢警一體化”,在人員配置、職責(zé)分工、工作機(jī)制等方面大膽創(chuàng)新,提高職務(wù)犯罪偵查工作的質(zhì)量和效率。最后,本文對(duì)偵查手段、偵查隊(duì)伍的專業(yè)化建設(shè)、機(jī)動(dòng)偵查權(quán)等職務(wù)犯罪偵查工作中的具體問(wèn)題,提出了相應(yīng)的完善建議。
[Abstract]:The crime refers to the use of authority or state functionaries violate duty, infringing the normal activities of the state organs to order, resulting in the interests of the state and people suffered heavy losses, in accordance with the general laws of the State shall be subject to criminal punishment. The duty crime investigation as an important means to curb crime, in the trend of the current anti-corruption. Social concern, it is also a hot point in the academic circles and the judicial practice research. Through the effective exercise of the right of investigation of official offence, to restrict the power of power, not only can ensure the country staff to exercise their power properly, the more important is that it can realize the legal supervision of the power. The duty crime detection power allocation means the allocation and arrangement of duty crime investigation. At present, the exercise of our duty crime investigation by procuratorial organs alone, the internal disposition appeared divided In some areas, a beneficial attempt has been made in the construction of integrated mechanism. There are different voices in the current mode of distribution, whether in academia or in practice.
This article through overseas study, draw lessons from the foreign configuration of duty crime investigation, and review the history, development venation, makes some reflections on our country's duty crime investigatoryauthority configuration: that the procuratorial organs exercise the right of investigation of official offence is appropriate, is in line with China's specific national conditions, at the same time, in the the internal organs, all the exercise of duty crime investigation department integration, build an integration mechanism of duty crime investigation is the future development direction.
This paper is divided into three parts, the first part is an overview of the configuration of duty crime investigation. Firstly, the definition of a "crime", "duty crime investigation", "the basic concept of job-related crimes investigation of the right configuration, then the nature of the duty crime detection power in nature for a specific analysis. The investigation, the current theory and judicial practice department mainly has the following understanding: judicial power; administrative power; judicial power and executive power dual nature; the power of legal supervision. The external characteristics of power and clarify the essential attribute of the crime investigation, that the nature of right form with some characteristics of executive power of legal supervision power.
The procuratorial organs to exercise the right of investigation of official offence on the basis of the second part. First, through overseas study, study and comparison of several models of foreign configuration of duty crime investigation, and summarizes the relevant characteristics of mode configuration extraterritorial investigation. Secondly, review the history, clarifies the development of configuration of the duty crime investigation right in China, and introduced the current situation. Finally, through four modes respectively discusses our country duty crime investigation power configuration, and analyses their advantages and disadvantages, put forward the views of this article by the procuratorial organs exercise the right of investigation of official offence is appropriate.
The third part elaborates the internal configuration of the duty crime detection power. First, combing the history of procuratorial organs, the establishment and alteration of the duty crime investigation mechanism, and briefly lists the current procuratorial organs of the Department and the authority set. Then, this paper puts forward the basic conception of the duty crime detection power internal configuration that is, the implementation of the construction of the integration mechanism of duty crime investigation establishing centralized duty crime investigation system. In addition, the procuratorial organs also strive to achieve the integration of police and procurator "in the personnel allocation, the division of responsibilities, working mechanism and other aspects of bold innovation, improve the duty crime investigation work quality and efficiency. Finally, the means of investigation. Professional construction team investigation, the specific problems of maneuvering and other crimes investigation right in investigation work, and put forward the corresponding improvement suggestions.
