出監(jiān)罪犯教育改造的“星城模式”研究

【摘要】:出監(jiān)罪犯教育改造模式是實現(xiàn)出監(jiān)罪犯由“監(jiān)獄人”轉化為“社會人”角色的關鍵環(huán)節(jié),在監(jiān)獄對出監(jiān)罪犯的改造中具有十分重要的地位。湖南星城監(jiān)獄的出監(jiān)教育建設實踐首開國內先河,建立了職業(yè)培訓、技能鑒定、就業(yè)指導、職業(yè)推介、跟蹤服務五環(huán)連動、環(huán)環(huán)緊扣的工作模式,在預防和減少重新犯罪,促進社會和諧穩(wěn)定方面作出了積極貢獻,形成了特色型出監(jiān)罪犯教育改造的“星城模式”。 本文第一部分概述了出監(jiān)罪犯教育改造的相關理論依據(jù),介紹了出監(jiān)罪犯、出監(jiān)罪犯教育改造及其“星城模式”的含義,第二部分描述了“星城模式”的體系包括教育體系、職業(yè)培訓體系、社會銜接體系、評估體系、社會適應體系等,第三部分通過結構式訪談法,對“星城模式”的成效進行了調查和描述,結果顯示出監(jiān)階段的教育培訓對出監(jiān)罪犯自身的影響較大,就業(yè)、創(chuàng)業(yè)比例較高,融入家庭和社會的情況比較理想。第四部分對星城監(jiān)獄出監(jiān)罪犯教育改造存在的問題進行了梳理,指出其發(fā)展瓶頸有管理體制不順和政策法律法規(guī)體系不健全;場地規(guī)模狹小和監(jiān)獄建設分散化;專業(yè)設置較少和技術人才匱乏;出監(jiān)教育改造內容范圍狹窄;財政保障沒有全額到位;社會管理和安置幫教工作落實不到位。第五部分提出了“星城模式”的發(fā)展對策:建立完善出監(jiān)教育改造的規(guī)范體系;探索符合出監(jiān)監(jiān)獄規(guī)律的監(jiān)管執(zhí)法工作體系;集中擴建出監(jiān)監(jiān)獄和理順出監(jiān)教育管理體制;調整優(yōu)化專業(yè)設置和教育師資隊伍結構;擴展出監(jiān)教育改造內容范圍和實行專項財政保障;建立完善社會支持系統(tǒng)。
[Abstract]:The mode of education reform of prisoners out of prison is a key link in the transformation of prisoners from "prison people" to "social persons", and plays a very important role in the reform of prisoners out of prison.The practice of education construction in Xingcheng prison in Hunan Province is the first in China, with the establishment of a work model of vocational training, skill appraisal, employment guidance, career promotion, tracking service, and close links, in order to prevent and reduce recidivism.In promoting social harmony and stability, we have made positive contributions and formed the "Star City Model" for the education and reform of prisoners out of prison with special characteristics.The first part of this paper summarizes the relevant theoretical basis for the education and reform of prisoners in prison, introduces the meaning of the education reform of criminals out of prison and the "Star City Model". The second part describes the system of "Star City Model", including the education system.Vocational training system, social cohesion system, evaluation system, social adaptation system, etc. The third part investigates and describes the effectiveness of the "Star City Model" through structured interviews.The results showed that the education and training in the prison stage had a great influence on the criminals themselves, the employment rate was higher, the proportion of entrepreneurship was higher, and the situation of integration into the family and society was relatively ideal.The fourth part combs the problems existing in the education and reform of the criminals in Xingcheng prison, pointing out that the development bottlenecks are the management system is not good and the policy and laws system is not perfect, the scale of the site is small and the prison construction is decentralized.Less professional setup and lack of technical personnel; limited scope of education and reform content; financial security is not fully in place; social management and placement of help and education work is not in place.The fifth part puts forward the development countermeasures of the "Star City Model": establishing and perfecting the standard system of education reform, exploring the system of supervision and law enforcement in accordance with the law of prison out of prison, expanding the prison management system and straightening out the management system of prison education;Adjust and optimize the structure of professional setup and teaching staff; expand the scope of the reform of supervision education and implement special financial security; establish and improve the social support system.
