【摘要】：檢察官管理制度是檢察制度的一個重要組成部分,對于保障檢察官依法獨立行使檢察權,履行法律監(jiān)督職能,規(guī)范檢察官公正執(zhí)法,確保法律統(tǒng)一正確實施,具有非常重要的意義。近年來,關于如何完善我國現(xiàn)行檢察官管理體制,在理論界和實踐界都進行了有益探索。建立一支職業(yè)化、精英化、司法化的檢察官隊伍,有效解決當前檢察機關檢察人員混編管理、人崗不適、檢察官緊缺等問題,是完善檢察官管理體制和深化司法體制改革的重要內(nèi)容,也是檢察官獨立的題中應有之義。而實現(xiàn)這一目的的必然路徑就是對檢察官實行分類管理。本文以此為出發(fā)點,從檢察官管理體制的理論支撐入手,借鑒國外檢察官管理體制經(jīng)驗,對現(xiàn)行檢察官管理制度進行分析,探討如何理順當前檢察人員管理體制關系,對檢察人員分類劃分、職業(yè)保障等進行研究,以期對完善檢察官管理體制、推進檢察官分類管理提供一些建議和思路。
[Abstract]:The procurator management system is an important part of the procuratorial system. It can guarantee the procurators to exercise procuratorial power independently according to law, perform the function of legal supervision, standardize the fair law enforcement of prosecutors, and ensure the unified and correct implementation of the law. In recent years, how to perfect the current procurator management system of our country has carried on the beneficial exploration in the theory circle and the practice circle. It is an important content to improve the procurator management system and deepen the reform of the judicial system to effectively solve the problems such as the mixed management of procuratorial personnel in the current procuratorial organs, the lack of qualified personnel and the shortage of procurators. And the inevitable way to achieve this goal is to carry out classified management of the procurators. This paper takes this as the starting point and starts with the theoretical support of the procurator management system. Based on the experience of foreign procurator management system, this paper analyzes the current procurator management system, discusses how to straighten out the relationship between the current procuratorial personnel management system, studies the classification of procuratorial personnel, occupational security, and so on. In order to perfect the procurator management system and promote the classified management of prosecutors to provide some suggestions and ideas.
