【摘要】：人類社會(huì)進(jìn)入21世紀(jì),受金融危機(jī)、恐怖主義的影響,社會(huì)活動(dòng)發(fā)生重大變化,國(guó)際國(guó)內(nèi)形勢(shì)更加復(fù)雜多變。與之相對(duì)應(yīng),當(dāng)前犯罪現(xiàn)象日趨多樣化、智能化、國(guó)際化,監(jiān)獄工作面臨的形勢(shì)更加復(fù)雜多變,這對(duì)監(jiān)獄系統(tǒng)的安全穩(wěn)定提出了更新更高的要求。隨著我國(guó)經(jīng)濟(jì)、社會(huì)的進(jìn)步,我國(guó)監(jiān)獄系統(tǒng)在懲罰和改造罪犯工作中取得了舉世矚目的成就,監(jiān)獄的建設(shè)不斷取得進(jìn)步,然而監(jiān)獄危機(jī)卻并沒有因?yàn)槲覈?guó)監(jiān)獄系統(tǒng)的不斷發(fā)展而消失,呼和浩特第二監(jiān)獄暴動(dòng)越獄案等一系列危機(jī)時(shí)刻提醒我們,監(jiān)獄系統(tǒng)的安全穩(wěn)定關(guān)系著國(guó)家的長(zhǎng)治久安,關(guān)系到社會(huì)的和諧。監(jiān)獄危機(jī)管理能力的高低已經(jīng)成為衡量我國(guó)監(jiān)獄管理水平的一項(xiàng)重要指標(biāo),開展監(jiān)獄危機(jī)管理體系的研究對(duì)于促進(jìn)我國(guó)監(jiān)獄系統(tǒng)的安全穩(wěn)定,豐富我國(guó)監(jiān)獄系統(tǒng)理論研究具有十分重要的現(xiàn)實(shí)意義和理論價(jià)值。 本文從分析監(jiān)獄危機(jī)與危機(jī)管理的概念性問(wèn)題入手,選取了“4R模型”、“五階段模型”及“RHED”理論分別作為本文所論述的監(jiān)獄危機(jī)管理的理論基礎(chǔ)與主要體系。運(yùn)用比較分析法,通過(guò)分析美國(guó)在監(jiān)獄危機(jī)管理方面的經(jīng)驗(yàn)及不足進(jìn)行比較分析,進(jìn)而引出監(jiān)獄危機(jī)管理體系存在重心前移、決策層由大而全轉(zhuǎn)向小而精、常態(tài)化三個(gè)監(jiān)獄危機(jī)管理體系發(fā)展趨勢(shì)。 本文通過(guò)對(duì)呼和浩特第二監(jiān)獄“10.17”暴動(dòng)越獄案的反思以及并運(yùn)用半結(jié)構(gòu)性訪談法進(jìn)行的實(shí)證調(diào)查和分析,認(rèn)為當(dāng)前我國(guó)監(jiān)獄危機(jī)管理存在著理念落后、缺乏法律和制度保障、缺乏常態(tài)化、運(yùn)轉(zhuǎn)有效的領(lǐng)導(dǎo)和執(zhí)行機(jī)構(gòu)、與普通大眾信息溝通的深度與廣度不夠等問(wèn)題,這些問(wèn)題的存在制約著我國(guó)監(jiān)獄危機(jī)管理的發(fā)展。而半結(jié)構(gòu)性訪談研究表明:目前有很多監(jiān)獄人民警察將監(jiān)獄危機(jī)管理與突發(fā)事件的應(yīng)對(duì)對(duì)等的現(xiàn)象,對(duì)于危機(jī)管理的理論學(xué)習(xí)上主動(dòng)性不高,特別是從事基層工作的干警主動(dòng)性更不高。對(duì)于監(jiān)獄危機(jī)管理體系的構(gòu)建已經(jīng)形成了比較好的想法,但這些想法大部分只是局部性的、分散的。建立監(jiān)獄系統(tǒng)危機(jī)管理體系需要強(qiáng)大的人力、財(cái)力做后盾�？上驳氖�,監(jiān)獄危機(jī)管理理論被越來(lái)越多的監(jiān)獄人民警察接受。這也印證了當(dāng)前我國(guó)監(jiān)獄危機(jī)管理體系存在的問(wèn)題是客觀存在的。 根據(jù)“4R模型”以及“RHED理論”,本文認(rèn)為為當(dāng)前我國(guó)監(jiān)獄危機(jī)管理體系就是縮減階段、預(yù)備階段、反應(yīng)階段和恢復(fù)階段的整合。 監(jiān)獄系統(tǒng)在縮減階段主要從危機(jī)管理制度的制定和危機(jī)意識(shí)的增強(qiáng)等方面進(jìn)行危機(jī)管理,將危機(jī)發(fā)生的概率降至最低,在預(yù)備階段主要是進(jìn)行危機(jī)控制,監(jiān)獄系統(tǒng)應(yīng)該側(cè)重建立預(yù)警信息系統(tǒng)、決策核心、執(zhí)行機(jī)構(gòu)、危機(jī)管理預(yù)案等基礎(chǔ)設(shè)施,當(dāng)然這些基礎(chǔ)設(shè)施的建立離不開強(qiáng)大的人力和財(cái)力支持,因此,確保監(jiān)獄危機(jī)管理的物質(zhì)基礎(chǔ)和監(jiān)獄人民警察危機(jī)管理培訓(xùn)制度也是十分重要的。當(dāng)監(jiān)獄危機(jī)的發(fā)生不可避免時(shí),監(jiān)獄危機(jī)管理體系就進(jìn)入反應(yīng)階段,在此階段的主要工作是進(jìn)行危機(jī)處置。監(jiān)獄系統(tǒng)在此階段主要從建立和完善新聞發(fā)言人制度及快速反應(yīng)機(jī)制入手,對(duì)監(jiān)獄危機(jī)進(jìn)行有效的處置。對(duì)監(jiān)獄危機(jī)處置完畢后,監(jiān)獄危機(jī)管理體系進(jìn)入恢復(fù)階段,也就是進(jìn)行危機(jī)善后。通過(guò)成立專家委員會(huì)對(duì)監(jiān)獄危機(jī)管理的縮減、預(yù)備、反應(yīng)三個(gè)階段進(jìn)行總結(jié)和學(xué)習(xí),如果存在監(jiān)獄人民警察瀆職、玩忽職守等現(xiàn)象,必須進(jìn)行責(zé)任追究。
[Abstract]:The human society entered the twenty-first Century, by the financial crisis, the impact of terrorism, social activities and major changes in the international and domestic situation is more complicated. Correspondingly, the phenomenon of crime is becoming more diverse, intelligent, internationalization, the prison situation facing more complex and changeable, put forward higher requirements on the prison system security and stability. Along with our country economy, social progress, China's prison system has made remarkable achievements in the punishment and reform of criminals in prison construction progress, however, the prison crisis is not because of the continuous development of China's prison system disappeared, Hohhot second prison riot escape case and a series of crisis remind us that the security and stability of the prison system in relation to the country's long period of stability, related to social harmony. The capacity of jail crisis management has become An important index to measure the management level of our prisons is to carry out the research of prison crisis management system, which is of great practical significance and theoretical value for promoting the safety and stability of our prison system and enriching the theoretical research of our prison system.
The conception of the prison crisis and crisis management, select the "4R model", "five stage model" and "RHED" theory as the theoretical basis and system were mainly of jail crisis management discussed in this paper. By using the comparative analysis method, comparative analysis by analyzing the experience and deficiency in the prison crisis management the United States, which leads to the prison crisis management system is to move the focus of decision-making turned into small and fine, the normalization of the three development of the prison crisis management system.
Through empirical investigation and Analysis on the "10.17" Hohhot second prison riot escape case and using a semi-structured interview method, that the current prison crisis management of our country exists behind the idea, the lack of legal and institutional guarantee, lack of normal operation, effective leadership and execution mechanism, and the depth and breadth the general public information communication is not enough, these problems are restricting the development of China's prison crisis management. The research of semi-structured interviews indicates that there are a lot of prison police jail crisis management and emergency response equivalence for the theory of crisis management learning initiative is not high, especially not the high officers engaged in grass-roots work initiative. For the construction of the prison crisis management system has formed a good idea, but most of these ideas is the only local The establishment of crisis management system. The decentralized prison system needs a strong human, financial backing. Fortunately, the theory of crisis management of prison prison police more and more acceptable. It also confirms the existence of the prison crisis management system in China is the objective existence.
According to the "4R model" and "RHED theory", this paper thinks that for our current prison crisis management system is the reduction stage, the integration stage of the preparation stage, the reaction stage and the recovery stage.
The prison system in the reduction phase mainly from the development of crisis management system and crisis awareness of crisis management, the probability of crisis to a minimum, in the run-up to the crisis is the main control, the prison system should focus on the establishment of early warning information system, decision-making core, executive mechanism, crisis management plans and other infrastructure, of course the establishment of these infrastructure cannot do without the strong support of human and financial resources, therefore, to ensure the system foundation and prison police crisis management training prison crisis management is very important. When the prison crisis is inevitable, the prison crisis management system into the reaction stage, the main work in this stage is dealing with the crisis. The prison system at this stage mainly from the establishment and perfection of the news spokesman system and rapid reaction mechanism, the effective of the prison crisis The disposal of the prison. After dealing with the crisis, the prison crisis management system into the recovery stage, also is the crisis. Through the establishment of the Committee of experts on the prison crisis management, reduction, preparation, reaction of three phases and learning, if there exists a prison police malfeasance, dereliction of duty and other phenomena, must be accountability.
