【摘要】：正修改后刑訴法完善了監(jiān)視居住的內(nèi)容,并新設(shè)了指定居所監(jiān)視居住之規(guī)定。其中,指定居所監(jiān)視居住是指,限令犯罪嫌疑人、被告人在規(guī)定的期限內(nèi)不得離開指定的居所,并對其行為加以監(jiān)視、限制其人身自由的一種強制措施。由于指定居所監(jiān)視居住限制犯罪嫌疑人、被告人人身自由的程度嚴厲于普通監(jiān)視居住,在適用中要更加嚴格、慎重。
[Abstract]:After the revision of the Criminal procedure Law, the contents of the surveillance residence have been perfected, and a new stipulation has been set for the designated residence to monitor the residence. Among them, the designated residence surveillance refers to the restriction of the criminal suspect and the accused not to leave the designated residence within the prescribed time limit. As a result of the designated residence to monitor the residence limit the criminal suspect, the defendant's personal freedom degree is harsher than the ordinary surveillance residence, and should be more strict and careful in the application.
