【摘要】:作為法家中的"別派",齊國(guó)法家的特色主要表現(xiàn)在《管子》德刑并用、教化與刑罰并舉的理論上,并認(rèn)為教化與刑罰存在著一種互動(dòng)、互相輔助的關(guān)系。而其提出的"法出于禮"的說(shuō)法,也體現(xiàn)了一種法家式的禮法合一觀(guān)念,反映了其對(duì)道德與法律之統(tǒng)一性的認(rèn)識(shí)。另外,《管子》的司法思想中還包括了"嚴(yán)刑罰"說(shuō)、刑罰"必信"說(shuō)以及"刑罰不頗"說(shuō)等等,弘揚(yáng)了嚴(yán)刑重罰、刑罰必信、司法公正等司法理念。
[Abstract]:As a "different school" in the family of law, the characteristics of the legalists of Qi country are mainly manifested in the theory of the combination of morality and punishment, the simultaneous development of education and punishment, and the conclusion that there is an interaction between education and punishment. The mutually auxiliary relationship, and his statement that "law comes from propriety" also embodies the concept of the unity of etiquette and law in the style of legalism. It reflects his understanding of the unity of morality and law. In addition, the judicial thought of Guanzi also includes the theory of "severe punishment", the theory of "must believe in punishment" and the theory of "punishment is not quite good", and so on.
