【摘要】：偵查訊問錄音、錄像制度最早起源于英國(guó)，經(jīng)過幾十年的發(fā)展目前廣泛應(yīng)用于偵查機(jī)關(guān)的訊問和詢問活動(dòng)。2006年3月1日，我國(guó)檢察機(jī)關(guān)在職務(wù)犯罪偵查訊問犯罪嫌疑人階段引入該制度，分“三步走”于2007年10月1日全國(guó)所有檢察機(jī)關(guān)全面實(shí)施。本文以我國(guó)檢察機(jī)關(guān)職務(wù)犯罪偵查訊問為視角，從檢察實(shí)務(wù)的角度出發(fā)，在肯定職務(wù)犯罪偵查實(shí)行全程同步錄音錄像意義和作用的同時(shí)，通過介紹國(guó)外及我國(guó)臺(tái)灣、香港地區(qū)訊問錄音錄像制度和實(shí)證研究，，著重對(duì)我國(guó)現(xiàn)行的訊問職務(wù)犯罪嫌疑人全程同步錄音錄像制度存在的問題進(jìn)行總結(jié)和反思，構(gòu)建和完善符合我國(guó)國(guó)情的同步錄音錄像制度。全文共分四章，大約2.6萬字。 第一章闡述了同步錄音錄像的性質(zhì)、特點(diǎn)及意義。本章主要對(duì)同步錄音錄像法律性質(zhì)進(jìn)行論證，為其作為偵查制度和證據(jù)的本質(zhì)“正名”。摒棄檢察機(jī)關(guān)以一己之力在推行同步錄音錄像制度時(shí)為了減輕來自不同部門的阻力而做的錯(cuò)誤宣傳，認(rèn)為同步錄音錄像是檢察機(jī)關(guān)的工作資料。 第二章介紹了同步錄音錄像制度在國(guó)外及我國(guó)臺(tái)灣、香港地區(qū)的規(guī)定。英國(guó)作為訊問錄音、錄像制度的發(fā)源地，經(jīng)歷了從警察開始抗拒到現(xiàn)在大力支持，顯現(xiàn)了同步錄音錄像制度的生命力和正確發(fā)展方向。同屬于中華文化的我國(guó)臺(tái)灣地區(qū)關(guān)于同步錄音錄像制度的規(guī)定及不脫離實(shí)際的做法也值得我們借鑒。 第三章對(duì)我國(guó)同步錄音錄像的實(shí)施現(xiàn)狀和存在問題進(jìn)行了評(píng)析。目前主要問題存在于：實(shí)施范圍過窄、法律屬性不明、規(guī)定過于絕對(duì)、錄制主體不中立，審錄分離難于做到，與犯罪嫌疑人意愿相矛盾、錄制的全程性和同步性難于做到、錄制中偵查人員存在不規(guī)范行為、出庭質(zhì)證效果與預(yù)期效果不相適應(yīng)、犯罪嫌疑人當(dāng)場(chǎng)簽字確認(rèn)難于執(zhí)行、經(jīng)費(fèi)保障難于支持等，這些問題阻礙同步錄音錄像制度發(fā)揮其應(yīng)有的作用。 第四章闡述同步錄音錄像制度的構(gòu)建和完善。即將實(shí)施的刑事訴訟法在偵查章訊問犯罪嫌疑人一節(jié)加入了同步錄音錄像制度作為第121條，使同步錄音錄像制度上升到國(guó)家立法層面。雖然有了法律依據(jù)，但實(shí)施中存在的問題依然沒有解決，需要盡快出臺(tái)同步錄音錄像實(shí)施細(xì)則，適當(dāng)擴(kuò)大實(shí)施范圍，構(gòu)建中立的錄制及監(jiān)督主體，完善錄音錄像法庭示證及采用制度，完善相關(guān)保障制度等。
[Abstract]:The system of audio and video recording of investigation and interrogation originated in Britain. After decades of development, it is widely used in interrogation and interrogation activities of investigative organs. In March 1st 2006, In October 1st 2007, the procuratorial organs of our country introduced this system in the stage of investigation and interrogation of criminal suspects in duty crime investigation, and implemented it in all procuratorial organs in China in October 1st 2007. This article takes the investigation and interrogation of duty crimes of procuratorial organs in China as a visual angle. From the point of view of procuratorial practice, while affirming the significance and function of simultaneous audio and video recording in the whole process of duty crime investigation, this paper introduces the audiovisual recording system and empirical research of interrogation in foreign countries and Taiwan and Hong Kong. This paper summarizes and reflects on the problems existing in the current system of simultaneous audio and video recording for the suspects of duty crime in our country, and constructs and consummates the synchronous audio and video recording system in accordance with the national conditions of our country. The full text is divided into four chapters, about 26,000 words. The first chapter expounds the nature, characteristics and significance of synchronous audio and video recording. To "correct the name" as the essence of the investigation system and evidence. To abandon the false propaganda made by the procuratorial organs on their own in carrying out the synchronous audio and video recording system in order to alleviate the resistance from different departments. It is considered that synchronous audio and video recording is the working data of the procuratorial organ. The second chapter introduces the regulations of the synchronous audio and video recording system in foreign countries and in Taiwan and Hong Kong of China. As the birthplace of the audio recording and video recording system for interrogation, the United Kingdom has experienced great support from the beginning of resistance by the police to the present. It shows the vitality and the correct development direction of the synchronous audio and video recording system. The regulations of the synchronous audio and video recording system and the practice of not deviating from the reality in Taiwan region, which belongs to Chinese culture, are also worthy of our reference. The third chapter analyzes the status quo and existing problems of synchronous audio and video recording in China. At present, the main problems are: the scope of implementation is too narrow, the legal attributes are not clear, the regulations are too absolute, the recording subject is not neutral, and the separation of review and recording is difficult to achieve. Contrary to the intention of the criminal suspect, it is difficult to achieve the whole process and synchronism of the recording, and the investigators in the recording have irregular behavior, the effect of cross-examination in court does not match with the expected effect, and it is difficult for the suspect to sign and confirm the crime on the spot. The fund guarantee is difficult to support, these problems hinder the synchronous audio and video system to play its due role. Chapter 4th expounds the construction and perfection of synchronous audio and video recording system. The criminal procedure law that is about to be implemented adds the synchronous audio and video recording system as the 121st article in the section on interrogation of criminal suspects in the investigation chapter. The system of synchronous audio and video recording has been raised to the level of national legislation. Although there is a legal basis, the problems existing in the implementation still remain unresolved. It is necessary to issue the detailed rules for the implementation of synchronous audio and video recordings as soon as possible and appropriately expand the scope of implementation. Set up neutral recording and supervising subject, perfect audio and video court proof and adoption system, perfect relevant safeguard system, etc.
