【摘要】：檢察機關(guān)探索檢察建議制度已經(jīng)多年,取得了豐富經(jīng)驗,產(chǎn)生了較好的法律效果與社會效果。但該制度的產(chǎn)生與發(fā)展系我國探索的產(chǎn)物,無他國經(jīng)驗可予借鑒。通過對該制度的考察后認(rèn)為,檢察機關(guān)應(yīng)當(dāng)整合各種規(guī)范性文件,提升關(guān)于該制度的法律位階,明確其法律地位,增強其法律權(quán)威,應(yīng)當(dāng)盡快提上立法工作日程。對其性質(zhì)的界定,可以將檢察建議看做是一種措施,是檢察機關(guān)實施法律監(jiān)督權(quán)的一種創(chuàng)新方式,這一司法措施應(yīng)通過完善立法來運行。但要針對不同的建議對象、建議內(nèi)容,設(shè)定強弱不同的法律效力。應(yīng)制定相關(guān)工作實施細(xì)則,規(guī)范檢察建議書制作標(biāo)準(zhǔn),完善績效考核、監(jiān)督落實等相關(guān)配套制度,整合檢察建議書、檢察意見書、糾正違法通知書等相關(guān)法律文書。 本文共分為四章,安排如下： 第一章概括闡述了檢察建議的概念。從檢察建議的概念入手,對檢察建議書與檢察意見書、糾正違法通知書等其他法律文書進行區(qū)別與分析。 第二章是對檢察建議制度的現(xiàn)狀考察。該部分包括檢察建議的法律規(guī)定考察、運行現(xiàn)狀以及該制度取得的效果。 第三章是對檢察建議制度的理論分析。通過檢察機關(guān)法律監(jiān)督屬性對檢察建議的必要性、功能以及運用原則進行了分析。 第四章是對檢察建議制度的完善建言。應(yīng)當(dāng)通過提高思想認(rèn)識、提升檢察建議的法律地位、完善檢察建議的運行程序、強化檢察建議的約束力等方式來完善檢察建議制度。
[Abstract]:The procuratorial organ has explored the procuratorial suggestion system for many years, has obtained the rich experience, has produced the better legal effect and the social effect, but the emergence and the development of this system is the product of our country's exploration. No other country's experience can be used for reference. After investigating the system, it is considered that procuratorial organs should integrate all kinds of normative documents, upgrade the legal rank of the system, clarify its legal status, and strengthen its legal authority. We should put it on the legislative agenda as soon as possible. In defining its nature, we can regard the procuratorial proposal as a measure and an innovative way for procuratorial organs to implement the power of legal supervision. This judicial measure should be run by perfecting the legislation. However, it should aim at different suggestion object, suggestion content, set different legal effect of strong or weak, should make relevant work implementation rules, standardize the standard of procuratorial proposal making, perfect the performance appraisal. Supervision and implementation of relevant supporting systems, integration of procuratorial proposals, procuratorial opinions, correction of illegal notices and other relevant legal documents. This paper is divided into four chapters, arranged as follows:. The first chapter generalizes the concept of procuratorial suggestion, starting with the concept of procuratorial suggestion, differentiating and analyzing other legal documents, such as procuratorial proposal and procuratorial opinion, correcting illegal notice and so on. The second chapter is a review of the present situation of the procuratorial suggestion system, which includes the inspection of the legal provisions of the procuratorial proposal, the current operation of the system and the effect of the system. The third chapter is the theoretical analysis of the procuratorial suggestion system. The necessity, function and application principle of the procuratorial suggestion are analyzed through the procuratorial organ's legal supervision attribute. Chapter 4th is about the perfection of the procuratorial suggestion system. We should improve the procuratorial suggestion system by improving the ideological understanding, improving the legal status of the procuratorial proposal, perfecting the operating procedure of the procuratorial proposal, and strengthening the binding force of the procuratorial proposal.
