【摘要】：正法院審判程序主要包括立案、審理、評議、制作并發(fā)放裁判文書等階段,每一個組成部分工作的細致和到位以及之間的良好過渡都是取得高質(zhì)量訴訟結果所必須。本文聚焦從評議得出裁判結果到制作裁判文書這一環(huán)節(jié),重點考察裁判文書與評議結果之間的關系,首次提出裁判文書與評議筆錄的匹配性這一概念,并從實踐的角度,探明該領域?qū)嶋H存在的問題,對出現(xiàn)問題的原因作出一定的理論探討,并進一步提出解決問題的辦法。
[Abstract]:The trial procedure of the court mainly includes the stages of filing, hearing, evaluating, making and issuing the judgment documents, and so on. Each part of the work of the meticulous and in place and a good transition between the need to achieve high-quality litigation results. Focusing on the relationship between the judgment document and the outcome of the review, this paper first puts forward the concept of the matching between the judgment document and the review record, and from the perspective of practice, to find out the actual problems in this field. The causes of the problems are discussed in theory, and the solutions to the problems are put forward.
