【摘要】：在裁判事實(shí)敘事構(gòu)建過(guò)程中,敘事者通過(guò)言語(yǔ)行為、修辭技巧將碎片化的證據(jù)信息整合成為完整的、融貫的、一致的故事模型,但該模型畢竟僅是敘事者對(duì)過(guò)往事實(shí)的次級(jí)感知,其內(nèi)容并不能引起內(nèi)心確信或者排除合理性懷疑,因此,司法裁決者有必要運(yùn)用批判性問(wèn)題評(píng)估法,在批判與回應(yīng)的對(duì)話剖面中檢驗(yàn)裁判事實(shí)建構(gòu)中的各種敘事主張,使主觀的懷疑接受客觀層次的檢驗(yàn),并從中識(shí)別出與故事假說(shuō)不符合的例外情形,予以排除或反駁,從而實(shí)現(xiàn)裁判事實(shí)敘事構(gòu)建中的"可接受性"。
[Abstract]:In the process of the construction of the referee's factual narration, the narrator integrates the fragmented evidential information into a complete, coherent and consistent story model through speech acts and rhetorical techniques. However, the model is only the narrator's secondary perception of the past facts, and its content can not lead to conviction or doubt of reasonableness. Therefore, it is necessary for the judicial adjudicators to use the critical problem evaluation method. In the dialogue section of critique and response, the author tests all kinds of narrative claims in the construction of the referee's facts, makes subjective doubt accept the test of objective level, and identifies the exception which does not accord with the story hypothesis. To exclude or refute, so as to achieve the "acceptability" in the construction of the factual narrative of the referee.
