【摘要】:2011年律師業(yè)已經(jīng)恢復(fù)32年了,律師業(yè)在社會(huì)生活和經(jīng)濟(jì)生活中發(fā)揮了重要的作用,但是,也面臨著前所未有的巨大的挑戰(zhàn)。法律服務(wù)競(jìng)爭(zhēng)異常激烈,律師事務(wù)所處于一個(gè)完全競(jìng)爭(zhēng)的市場(chǎng)中。四川思創(chuàng)遠(yuǎn)卓律師事務(wù)所(以下簡(jiǎn)稱(chēng)SCYZ)成立已經(jīng)十年,傳統(tǒng)的“小而全”運(yùn)行模式,制約了律師事務(wù)所的發(fā)展。 本文選擇對(duì)SCYZ商業(yè)模式創(chuàng)新來(lái)研究解決律師事務(wù)所發(fā)展瓶頸和提高核心競(jìng)爭(zhēng)力的問(wèn)題,探索律師事務(wù)所的發(fā)展道路。通過(guò)宏觀環(huán)境、微觀環(huán)境分析,參照中外律師事務(wù)所發(fā)展運(yùn)行模式,并進(jìn)行總結(jié)、比較和借鑒,將商業(yè)模式的核心三要素顧客、價(jià)值、利潤(rùn)匹配為適合SCYZ律師事務(wù)所商業(yè)模式的構(gòu)成要素,即目標(biāo)客戶(hù)、法律服務(wù)產(chǎn)品及載體(組織架構(gòu)與運(yùn)行機(jī)制)。以目標(biāo)客戶(hù)定位、法律服務(wù)產(chǎn)品選擇、組織架構(gòu)、營(yíng)運(yùn)機(jī)制設(shè)計(jì)為研究對(duì)象,對(duì)SCYZ商業(yè)模式做了創(chuàng)新性和探索性研究。主要內(nèi)容為: 1.通過(guò)對(duì)SCYZ目前狀況、內(nèi)部環(huán)境分析,研究律師事務(wù)所資源的優(yōu)勢(shì)、存在的問(wèn)題及需要改進(jìn)和創(chuàng)新的地方。 2.通過(guò)對(duì)與律師事務(wù)所營(yíng)運(yùn)有關(guān)的宏觀環(huán)境及法律服務(wù)市場(chǎng)的分析,研究SCYZ的業(yè)務(wù)發(fā)展方向、目標(biāo)客戶(hù)在什么地方。提出了SCYZ以中小企業(yè)法律顧問(wèn)市場(chǎng)為主,傳統(tǒng)業(yè)務(wù)市場(chǎng)及高端業(yè)務(wù)市場(chǎng)為輔的客戶(hù)定位。 3.詳細(xì)研究了SCYZ商業(yè)模式構(gòu)成要素,其中重點(diǎn)研究了客戶(hù)的潛在法律需求和長(zhǎng)期法律需求;通用法律服務(wù)產(chǎn)品和專(zhuān)用法律服務(wù)產(chǎn)品。研究了SCYZ能夠給客戶(hù)提供什么樣的服務(wù),給客戶(hù)帶來(lái)什么價(jià)值,如何實(shí)現(xiàn)服務(wù)的問(wèn)題。提出了SCYZ業(yè)務(wù)發(fā)展專(zhuān)業(yè)化,,律師個(gè)人專(zhuān)家化,法律服務(wù)產(chǎn)品化的發(fā)展方向。 創(chuàng)新提出“以客戶(hù)需求設(shè)計(jì)服務(wù)產(chǎn)品,以服務(wù)產(chǎn)品化,帶動(dòng)律師事務(wù)所專(zhuān)業(yè)化發(fā)展”的SCYZ商業(yè)模式。通過(guò)商業(yè)模式的實(shí)施,形成律師事務(wù)所核心競(jìng)爭(zhēng)力,從而實(shí)現(xiàn)可持續(xù)發(fā)展。在SCYZ商業(yè)模式的構(gòu)成要素中,創(chuàng)新提出“一所兩制”的組織架構(gòu)。
[Abstract]:In 2011, the lawyer industry has been restored for 32 years, which has played an important role in social and economic life. However, it is also facing an unprecedented huge challenge. The competition for legal services is extremely fierce. The law firm is in a completely competitive market. Sichuan Sichuangyuan law firm (hereinafter referred to as SCYZ) has been established for ten years, the traditional "small and full" mode of operation. Restricted the development of the law firm. This paper chooses the innovation of SCYZ business model to study and solve the bottleneck of the development of law firms and improve the core competitiveness of law firms, explore the development of law firms, through the macro-environment, micro-environment analysis. Reference to the development of Chinese and foreign law firms operating mode, and summary, comparison and reference, the core three elements of the business model customer, value. Profit matching is the key element of the business model of SCYZ law firm, that is, target customer, legal service product and carrier (organization structure and operation mechanism) to target customer orientation, choice of legal service product. Organizational structure, operating mechanism design as the research object, the innovative and exploratory research on the SCYZ business model. The main contents are as follows: 1. By analyzing the current situation and internal environment of SCYZ, the paper studies the advantages of law firms' resources, the existing problems and the areas that need to be improved and innovated. 2. Through the analysis of the macro environment and legal service market related to the operation of law firms, the development direction of SCYZ business is studied. Where are the target customers. This paper puts forward the customer orientation of SCYZ, which is based on the legal consultant market of small and medium-sized enterprises, supplemented by the traditional business market and the high-end business market. 3. Research the elements of SCYZ business model in detail, and focus on the potential legal needs of customers and long-term legal needs; General legal service product and special legal service product. This paper studies what kind of service SCYZ can provide to the customer and what value it brings to the customer. How to realize the service, this paper puts forward the development direction of the SCYZ business development specialization, the lawyer individual expert, the legal service product development direction. This paper puts forward the SCYZ business model of "designing the service products according to the customer's needs, turning the service products into products and driving the professional development of the law firms". The core competence of law firms is formed to realize sustainable development. Among the elements of SCYZ business model, innovation puts forward the organizational structure of "one institution, two systems".
