【摘要】：隨著世界經(jīng)濟(jì)的發(fā)展,社會(huì)的轉(zhuǎn)型,黑惡勢力犯罪作為一種特殊的犯罪形式,嚴(yán)重影響了人民群眾的生命財(cái)產(chǎn)安全,影響了社會(huì)穩(wěn)定與健康發(fā)展,日益成為世界各國普遍關(guān)注的熱點(diǎn)問題。隨著科學(xué)技術(shù)的發(fā)展,黑惡勢力犯罪的組織形式日益嚴(yán)密,手段日益多樣化,并且與恐怖犯罪,毒品犯罪等結(jié)合,引起社會(huì)的廣泛關(guān)注。黑惡勢力犯罪愈演愈烈,不僅嚴(yán)重危害人民的生命財(cái)產(chǎn)安全和社會(huì)秩序,而且還有可能嚴(yán)重破壞一個(gè)國家的經(jīng)濟(jì)發(fā)展和政局穩(wěn)定,尤其是隨著交通、通訊、商業(yè)和旅游的發(fā)展,國家和各國人民之間的交往日益頻繁,黑惡勢力犯罪已步出國界,其活動(dòng)和危害范圍遠(yuǎn)遠(yuǎn)超出了一個(gè)國家的范圍。黑惡勢力犯罪對于當(dāng)今世界各國的和平和發(fā)展構(gòu)成了極大的威脅,同時(shí)也對各國傳統(tǒng)的立法模式和司法體制構(gòu)成了挑戰(zhàn),必須堅(jiān)決打擊、依法鏟除,“打黑除惡”就作為我國打擊黑惡勢力犯罪的術(shù)語應(yīng)運(yùn)而生。 雖然對黑惡勢力犯罪問題的研究在最近幾年已經(jīng)成為我國刑法界關(guān)注的熱點(diǎn)、難點(diǎn)問題之一,對黑惡勢力犯罪的研究也很多,其中有很多優(yōu)秀的成果,但大都是從黑惡勢力犯罪的概況、特征、形成原因、立法對策等方面進(jìn)行的研究,對黑惡勢力罪犯的行刑問題的研究則相對薄弱,進(jìn)度緩慢。行刑是刑事訴訟的最后階段,也是實(shí)現(xiàn)公平正義的最后保障。目前行刑的總體效果是好的,但執(zhí)行過程中仍有很多問題,如牢頭獄霸,不當(dāng)減刑等,這在一定程度上影響了黑惡勢力犯罪相關(guān)問題的深入研究和解決,對此有必要進(jìn)一步提高認(rèn)識(shí)。 本文以唯物辯證法為指導(dǎo),科學(xué)運(yùn)用因果分析法、利益分析法、理論聯(lián)系實(shí)際等多種分析方法,認(rèn)真分析了我國在對黑惡勢力罪犯行刑過程中存在的問題,借鑒聯(lián)合國、美國、英國等懲治有組織犯罪政策的經(jīng)驗(yàn),立足我國基本國情與社會(huì)現(xiàn)實(shí),爭取對完善我國對黑惡勢力罪犯的行刑措施提出建設(shè)性的意見,以期對我國的打黑除惡斗爭作出一點(diǎn)貢獻(xiàn)。
[Abstract]:With the development of the world economy and the transformation of the society, as a special form of crime, the crime of criminal and evil forces has seriously affected the life and property safety of the people, and affected the social stability and healthy development. With the development of science and technology, the criminal organizations of criminal and evil forces are becoming more and more strict, the means are becoming more and more diverse, and they are combined with terrorist crimes, drug crimes and so on. It not only seriously endangers the people's life and property safety and social order, but also seriously undermines the economic development and political stability of a country. Especially with the development of transportation, communication, commerce and tourism, the communication between countries and peoples has become more and more frequent. The scope of its activities and harm goes far beyond the scope of one country. Crime by criminal and evil forces poses a great threat to the peace and development of all countries in the world today. At the same time, it has also posed a challenge to the traditional legislative model and judicial system of various countries, and must be resolutely cracked down and eradicated according to law. "cracking down on criminal elements and eliminating evil" has become the term for cracking down on crimes committed by criminal and evil forces in our country. Although in recent years, the research on the crime of criminal and evil forces has become a hot spot in the criminal law circle of our country, one of the difficult problems, there are also a lot of research on crime of criminal and evil forces, among which there are a lot of excellent results. But mostly from the criminal situation, characteristics, formation reasons, legislative countermeasures and other aspects of the research, the execution of criminal criminal is relatively weak. Slow progress. Execution is the last stage of criminal proceedings, but also the final guarantee to achieve fairness and justice. At present, the overall effect of execution is good, but there are still many problems in the implementation process, such as prison prison, improper commutation and so on. To a certain extent, this has affected the in-depth study and solution of criminal problems related to criminal activities of criminal and evil forces, and it is necessary to further improve our understanding of this problem. Under the guidance of materialist dialectics, using causality analysis, benefit analysis, theory combined with practice and other analytical methods, this paper seriously analyzes the problems existing in the execution of criminal of evil and criminal forces in our country. Draw lessons from the United Nations, the United States, the United Kingdom and other policies to punish organized crime experience, based on the basic situation of China and social reality, strive to improve our criminal execution of criminal evil forces to put forward constructive suggestions. With a view to our fight against crime and evil to make a little contribution.
