【摘要】：我國正處于社會經(jīng)濟發(fā)展方式轉(zhuǎn)型的關(guān)鍵期,社會上普遍存在著經(jīng)濟文化發(fā)展不平衡的特點,在這樣矛盾突顯的社會里,傳統(tǒng)的糾紛解決方式已經(jīng)不能滿足人們?nèi)找嫣岣叩膶m紛解決效果的要求,尤其是在巨變后的鄉(xiāng)土社會里,古老的厭訴心理已經(jīng)被激烈的利益之爭所掩蓋,曾經(jīng)被譽為“東方經(jīng)驗”的人民調(diào)解制度對于轉(zhuǎn)型期的矛盾糾紛也無能為力,或者說隨著鄉(xiāng)土社會的變遷以及人們法律意識、訴訟意識的提高,調(diào)解已經(jīng)不再是人們唯一的糾紛解決機制,訴訟作為一種倍受推崇的糾紛解決方式逐漸深入人心,越來越多的村民進城打官司,秋菊打官司的尷尬境地已經(jīng)遠去,這樣的變化可以說有喜有憂,喜在我國改革開放以來的普法活動沒有白費勁,取得了很大的進展,先進的法制觀念和法律意識深入人心;然而可悲的是中國幾千年來的儒家“和文化”被消磨殆盡,人與人之間變得生疏冷漠,曾經(jīng)的親鄰近友對簿公堂,親情和友情不能再起到化解民間糾紛的作用,逐漸的鄉(xiāng)土社會出現(xiàn)一些不穩(wěn)定的因素,多年的村莊和諧一點點的被打破,積極的訴訟并不能更好的解決鄉(xiāng)土社會人們之間的矛盾,并不能實現(xiàn)定紛止?fàn)�、促進社會穩(wěn)定的目的,在巨變后的鄉(xiāng)土社會里更需要人民調(diào)解制度來解決糾紛,維護鄉(xiāng)土社會的秩序。因此,了解當(dāng)代中國鄉(xiāng)土社會的實際情況,實事求是地研究當(dāng)代中國鄉(xiāng)土社會的糾紛及其解決的現(xiàn)狀,并切實可行的提出后鄉(xiāng)土社會應(yīng)有的糾紛解決機制,這樣對于維護鄉(xiāng)土社會的穩(wěn)定,促進鄉(xiāng)土社會的進一步發(fā)展,構(gòu)建和諧社會,具有極其重要的意義。本文介紹傳統(tǒng)的人民調(diào)解制度,并從法律社會學(xué)的研究視角,研究傳統(tǒng)的鄉(xiāng)土社會之糾紛調(diào)解機制的運作狀態(tài),盡可能客觀地描述鄉(xiāng)土社會糾紛解決的實際情況。探討當(dāng)代中國鄉(xiāng)土社會人們之間糾紛的變化,深刻分析人民調(diào)解制度在當(dāng)代中國鄉(xiāng)土社會的運行環(huán)境,揭示出人民調(diào)解制度在后鄉(xiāng)土社會逐漸被邊緣化的社會原因。最后,為了維護鄉(xiāng)土社會的穩(wěn)定,促進社會的和諧發(fā)展,提出了健全和完善人民調(diào)解制度在后鄉(xiāng)土社會運行的應(yīng)走之路。
[Abstract]:Our country is in the key period of the transformation of the mode of social and economic development. There is a general imbalance of economic and cultural development in the society. Traditional dispute resolution has not been able to meet the increasing demand for the effect of dispute resolution, especially in the rural society after the great changes, the ancient psychology of litigation has been veiled by the fierce interests of the dispute. The people's mediation system, once known as the "oriental experience", is also powerless for the contradictions and disputes in the transitional period, or with the changes of the local society and the improvement of people's legal consciousness and litigation consciousness. Mediation is no longer the only dispute resolution mechanism, litigation as a highly respected way of dispute resolution gradually become popular, more and more villagers go to the city to file a lawsuit. The embarrassing situation of Qiuju litigation has gone far away, such changes can be said to have mixed ups and downs, happy in our country since the reform and opening up of the activities of legal popularization has not wasted effort, has made great progress. Advanced legal concepts and legal consciousness are deeply rooted in people's hearts; However, it is sad that the Confucian "and culture" of thousands of years in China have been exhausted, and people have become ethereal and indifferent, and the former close neighbors have come to court, and family and friendship can no longer play a role in resolving folk disputes. Gradually there are some unstable factors in the local society, many years of village harmony is broken little by little, positive litigation can not better solve the contradictions between people in the local society, can not achieve the resolution of disputes. In order to promote social stability, the people's mediation system is needed to resolve disputes and maintain the order of local society in the rural society after the great changes. Therefore, understand the actual situation of contemporary China's rural society. In order to maintain the stability of the local society, it is necessary to study the present situation of disputes and their resolution in contemporary Chinese rural society realistically, and put forward the dispute resolution mechanism of post-local society. It is of great significance to promote the further development of local society and build a harmonious society. This paper introduces the traditional people's mediation system and from the perspective of legal sociology. This paper studies the operation state of the traditional dispute mediation mechanism in the local society, describes the actual situation of the dispute resolution in the local society as objectively as possible, and probes into the changes of the disputes among the people in the contemporary Chinese rural society. This paper deeply analyzes the operating environment of the people's mediation system in the contemporary Chinese rural society, and reveals the social reasons why the people's mediation system is gradually marginalized in the post-local society. Finally, in order to maintain the stability of the local society. In order to promote the harmonious development of the society, this paper puts forward the way to perfect and perfect the people's mediation system in the post-local society.
