中英法律語言模糊性現(xiàn)象的對(duì)比研究

法律語言學(xué)是一門新興學(xué)科，是研究法律和語言關(guān)系的一種專門用途語言學(xué)。法律或者法是由政府或者其它權(quán)利機(jī)構(gòu)制定或認(rèn)可的準(zhǔn)則、規(guī)定、規(guī)則等。它通過規(guī)定人們的權(quán)利和義務(wù)來確認(rèn)、保護(hù)和發(fā)展社會(huì)關(guān)系和社會(huì)秩序。它與人們的生活息息相關(guān)。 語言是交際的橋梁，法律是通過語言來訂立和公布的。因此作為法律的語言必須精確、嚴(yán)謹(jǐn)，然而模糊是語言的固有屬性，法律語言也不能避免模糊現(xiàn)象。因此大量的模糊語言存在于法律語言中，對(duì)法律語言有著不容忽視的影響。前人就法律英語中的模糊現(xiàn)象進(jìn)行了大量研究，但很少涉及法律漢語。因此本文在介紹法律語言學(xué)的基礎(chǔ)上，分別從語義學(xué)和語用學(xué)角度對(duì)比研究中英法律語言的模糊性現(xiàn)象及其成因，提高英語學(xué)習(xí)者和法律語言研究者對(duì)中英法律語言模糊性現(xiàn)象的理解。
