美國(guó)死刑之文化考察

美國(guó)有一種獨(dú)特的死刑文化,這使她與其它西方發(fā)達(dá)工業(yè)國(guó)家有所不同,美國(guó)是二十一世紀(jì)西方發(fā)達(dá)工業(yè)國(guó)家中唯一的還擁有死刑制度的國(guó)家;在美國(guó),只要不違背特定的聯(lián)邦相關(guān)法律,每個(gè)州都有權(quán)自己決定刑罰制度,包括其死刑制度。但是,死刑這一殖民統(tǒng)治時(shí)期從英國(guó)殖民統(tǒng)治者那兒順承下來(lái)的傳統(tǒng),不僅對(duì)美國(guó)國(guó)內(nèi)社會(huì)文化環(huán)境和國(guó)際交往帶來(lái)不良影響,還會(huì)威脅到美國(guó)人為之自豪的民主制度。死刑到底應(yīng)該保留還是廢除,在美國(guó)國(guó)內(nèi)有激烈的爭(zhēng)論。為什么死刑存廢在美國(guó)國(guó)內(nèi)引起如此激烈的爭(zhēng)論?而一個(gè)無(wú)可辯駁的事實(shí)是美國(guó)的死刑制度一直延續(xù)到了今天,但是另一個(gè)明顯的跡象就是進(jìn)入二十一世紀(jì)以來(lái),美國(guó)民眾對(duì)死刑制度的支持率正在降低,美國(guó)的死刑使用在逐步地減少。這使人們不禁要問(wèn),為什么死刑制度可以長(zhǎng)時(shí)期在美國(guó)存在?哪些因素導(dǎo)致了美國(guó)的死刑制度陷于困境?美國(guó)的死刑制度在未來(lái)將會(huì)如何發(fā)展?本篇論文從美國(guó)文化和社會(huì)的角度分析了美國(guó)的死刑問(wèn)題,并對(duì)以上一些問(wèn)題做出了解答。 論文分為八章。 第一章 美國(guó)死刑情況概述。該章對(duì)美國(guó)的死刑情況做出了總體的描繪,描述了美國(guó)死刑制度的現(xiàn)狀并且分析了它的成因。 第二章 美國(guó)死刑的歷史和演變。該章...
