由命題出發(fā)的概念坐標系——也談法律史研究方法

【摘要】:在中國法律史的研究中,單一的考證或社會史方法只能研究古代法外在的"量"與"效",無法深究內(nèi)在之"質(zhì)"與"因",而規(guī)范分析的方法,雖能夠深入研究古代法的內(nèi)在機理,卻存在"以今日之見揣度前人"的潛在風(fēng)險。為避免這種風(fēng)險,應(yīng)建立一個由命題出發(fā)的概念坐標系,綜合運用考證、社會史、規(guī)范分析的方法,以在古今中西不同概念、思想、制度體系之間展開平等的"相互對釋"。這需要研究者對所比較的對象有同等深度的認識和學(xué)術(shù)根底,且在歷史觀和方法論上有深思熟慮的修養(yǎng)和整體系統(tǒng)的眼光。
[Abstract]:In the study of Chinese legal history, a single textual research or social history method can only study the external "quantity" and "effect" of ancient law, and can not deeply study the internal "quality" and "cause". Although the method of normative analysis can deeply study the internal mechanism of ancient law, there is the potential risk of "speculating on the predecessor from today's point of view". In order to avoid this risk, a conceptual coordinate system based on proposition should be established, and the methods of textual research, social history and normative analysis should be comprehensively used in order to carry out equal "mutual interpretation" between different concepts, ideas and systems between ancient and modern China and the West. This requires researchers to have the same depth of understanding and academic background of the objects compared, and to have a thoughtful cultivation and overall systematic vision in the view of history and methodology.
