【摘要】：作為法律實證主義的重要一脈,純粹法理論以純粹性與基礎規(guī)范為邏輯預設和理論支點,在此基礎上勉力建構法律與國家的一元互動。純粹法理論中所提出并試圖建構和實現(xiàn)的諸多理論議題及其獨特的方法論對推動我國法學研究的時代轉(zhuǎn)型和理論研究的精細化具有重要的借鑒意義和理論價值,我國的法學研究和法律實踐應當認真對待這種理論思潮。
[Abstract]:As an important vein of legal positivism, the pure law theory takes pureness and basic norms as the logical presupposition and theoretical fulcrum, on the basis of which it tries to construct the monistic interaction between law and the state. Many theoretical topics and their unique methodology put forward and tried to construct and realize in the pure law theory have important reference significance and theoretical value for promoting the transformation of the times and the refinement of the theoretical research in the legal research of our country. This theoretical trend of thought should be taken seriously in the study and practice of law in our country.
