【摘要】：社會轉(zhuǎn)型意味著社會體制的急劇變革和社會結(jié)構(gòu)的重大轉(zhuǎn)變,意味著社會秩序控制機(jī)制的轉(zhuǎn)型,"通過法律的社會控制"必然成為人們最明智的選擇。為克服"有法律無秩序"現(xiàn)象,應(yīng)當(dāng)通過以利益均衡為基礎(chǔ)回應(yīng)型法的建立,以及在此基礎(chǔ)上社會民眾法律信仰的培育和法律適用行為"合法性"的建構(gòu),使法律治理獲得社會心理的普遍支持。
[Abstract]:Social transformation means the rapid change of social system and the great change of social structure, and means the transformation of social order control mechanism. "Social control through law" is bound to become the wisest choice for people. In order to overcome the phenomenon of "legal disorder", we should establish the response type law on the basis of the balance of interests, as well as the cultivation of the legal belief of the public and the construction of the legality of the applicable behavior of the law. So that legal governance has been generally supported by social psychology.
