我國社會矛盾調(diào)解的法治化研究

【摘要】：社會的發(fā)展必然伴隨著矛盾的產(chǎn)生，尤其是對于我國這個快速發(fā)展中的國家，各種矛盾糾紛錯綜復雜，，對矛盾的正確調(diào)處顯得尤為重要，矛盾是促使社會發(fā)展進步的內(nèi)在動力。隨著我黨提出“依法治國，建設社會主義法治國家”的目標后，關(guān)于社會矛盾調(diào)解的法治化的相關(guān)研究不斷得到更多的關(guān)注。社會矛盾化解、社會管理創(chuàng)新、公正廉潔執(zhí)法是當前司法行政工作的三項重點工作，是中央根據(jù)我國國情、民情和經(jīng)濟社會發(fā)展現(xiàn)狀對司法工作提出的富有針對性的戰(zhàn)略部署，其中，社會矛盾化解是三項工作中的基礎，只有做好社會矛盾的化解才能有力的推進其他工作的展開，這足以說明社會矛盾的處理在我國現(xiàn)階段工作中的重要位置。 本文在對社會矛盾、社會矛盾調(diào)解以及法治化等相關(guān)基礎概念的界定和闡述的基礎上，通過對社會矛盾調(diào)解的法治化的可行性和有效性進行理論性的分析，確認社會矛盾調(diào)解的法治化的重要地位。在實踐方面，通過對我國現(xiàn)階段社會矛盾產(chǎn)生的原因，表現(xiàn)的形勢進行詳盡分析后，提出一種符合我國現(xiàn)階段社會矛盾特點的社會矛盾調(diào)解的法治化基礎框架。 本文共分五個大的部分。第一部分首先對現(xiàn)階段的研究現(xiàn)狀作了介紹，并對社會矛盾、社會矛盾調(diào)解及法治化等關(guān)鍵概念理論做了介紹。 第二部分介紹了法治化道路化解社會矛盾是大勢所趨，既是現(xiàn)實社會發(fā)展、矛盾糾紛解決的需要，也是我國依法治國方略的要求。 第三部分重點分析了我國現(xiàn)階段依法化解社會矛盾的實踐情況。社會矛盾的出現(xiàn)既有宏觀原因也有微觀原因。社會矛盾的形態(tài)主要表現(xiàn)在政治領(lǐng)域、經(jīng)濟領(lǐng)域和思想領(lǐng)域。尤其以經(jīng)濟領(lǐng)域的矛盾最為突出，包括貧富差距不斷擴大和就業(yè)形勢緊張等矛盾。在政治領(lǐng)域主要就表現(xiàn)為干群矛盾緊張。由于各種思潮交融，引發(fā)了人們對原有價值觀念的懷疑和動搖，尤其引發(fā)了思想領(lǐng)域各種矛盾沖突。文章主要從法律、政策、經(jīng)濟、行政、思想五個方面來分析，結(jié)合我國現(xiàn)階段國情，對各種化解社會矛盾的方法做了介紹和比較。 第四部分介紹了我國現(xiàn)階段依法化解社會矛盾存在的問題并分析其中的原因。 第五部分即文章最后詳細論述了社會矛盾調(diào)解法治化的原則和方法。結(jié)合筆者工作實際，論述了人民調(diào)解、司法調(diào)解、行政調(diào)解組成的“三調(diào)聯(lián)動”工作機制。
[Abstract]:The development of society must be accompanied by the emergence of contradictions, especially for China, a rapidly developing country, various contradictions and disputes are complicated, the correct adjustment of contradictions appears to be particularly important, contradictions are the internal driving force to promote social development and progress. With the goal of "ruling the country according to law and building a socialist country ruled by law" put forward by our party, more and more attention has been paid to the related research on the rule of law in the mediation of social contradictions. Resolving social contradictions, innovating social management, and enforcing the law in a fair and honest manner are the three key tasks of the current judicial administration work, and are the targeted strategic arrangements put forward by the central authorities for judicial work in the light of the national conditions of our country, the people's conditions and the current situation of economic and social development. Among them, the settlement of social contradictions is the basis of the three work, only to do a good job in resolving social contradictions can effectively promote the launch of other work, which is enough to show that the handling of social contradictions in China at the present stage of the important position in the work. On the basis of defining and expounding the related basic concepts such as social contradiction, social contradiction mediation and rule by law, this paper theoretically analyzes the feasibility and effectiveness of the rule of law of social contradiction mediation. Confirm the important position of the rule of law of social contradiction mediation. In practice, through the detailed analysis of the causes and situation of social contradictions in our country at present, this paper puts forward a legal-based framework of social contradiction mediation, which accords with the characteristics of social contradictions in our country at the present stage. This paper is divided into five major parts. The first part introduces the present situation of the research, and introduces the key concepts of social contradiction, social contradiction mediation and rule of law. The second part introduces the rule of law road to resolve social contradictions is the general trend, which is not only the real social development, the need to resolve contradictions and disputes, but also the rule of law in China. The third part focuses on the analysis of the practice of resolving social contradictions in accordance with the law at the present stage of our country. There are both macro and micro reasons for the emergence of social contradictions. The form of social contradiction mainly displays in the political field, the economic domain and the ideological field. In particular, the contradiction in the economic field is most prominent, including the widening gap between the rich and the poor and the tense employment situation. In the political field, the main manifestation is the contradiction and tension between the cadres and the masses. Because of the blending of various ideological trends, people doubt and shake the original values, especially the contradictions and conflicts in the ideological field. This article mainly from the law, the policy, the economy, the administration, the thought five aspects to analyze, unifies our country present stage national condition, has made the introduction and the comparison to the various methods to resolve the social contradiction. The fourth part introduces the existing problems of resolving the social contradictions in accordance with the law and analyzes the reasons. The fifth part is the last part of the article discusses in detail the principles and methods of the rule of law in the mediation of social contradictions. Combined with the author's practical work, this paper discusses the "three-tone linkage" working mechanism composed of people's mediation, judicial mediation and administrative mediation.
