【摘要】：借鑒文化的變遷機(jī)制,習(xí)慣法的變遷機(jī)制主要有濡化機(jī)制和涵化機(jī)制。濡化機(jī)制主要表現(xiàn)為習(xí)慣法在縱向的代際之間的傳承;而涵化機(jī)制主要是習(xí)慣法對(duì)其他規(guī)范體系的借取。正是在濡化機(jī)制和涵化機(jī)制的雙重作用下,民初的習(xí)慣法變遷演化為現(xiàn)今的習(xí)慣規(guī)范。
[Abstract]:Referring to the cultural change mechanism, the change mechanism of customary law mainly includes acculturation mechanism and acculturation mechanism. The mechanism of acculturation is mainly the inheritance of customary law between generations, while the mechanism of acculturation is the borrowing of customary law to other normative systems. Under the dual action of acculturation mechanism and acculturation mechanism, the change of customary law in the early Republic of China evolved into the present customary norm.
