【摘要】：法庭審理中的溝通往往以會話形式體現(xiàn),社會語言學(xué)維度下的庭審會話在遵循普遍會話原則的同時,有著自身的行業(yè)屬性:庭審會話不僅有知識圖示不對稱、權(quán)勢不對稱、心理不對稱以及案情不對稱的行業(yè)屬性,同時還有著違背數(shù)量準(zhǔn)則、質(zhì)量準(zhǔn)則、關(guān)系準(zhǔn)則和方式準(zhǔn)則的獨特現(xiàn)象。了解了庭審會話與一般會話的共性和特性,才能將其引入日常的案件審理中,提升案件審判的標(biāo)準(zhǔn)性和實效性。
[Abstract]:The communication in the court trial is often embodied in the form of conversation. In the sociolinguistic dimension, the trial session follows the general conversational principle and has its own industry attribute: the trial session has not only the asymmetry of knowledge schematics, but also the asymmetry of power and power. The industry attribute of psychological asymmetry and case asymmetry also has the unique phenomenon of violating the quantity criterion, the quality criterion, the relation criterion and the way criterion. Only by understanding the commonness and characteristics of trial session and general conversation can we introduce it into the daily trial and improve the standard and effectiveness of the trial.
