【摘要】：對商標(biāo)使用者利益的保護(hù),應(yīng)首先界定不同語境下的商標(biāo)使用人。針對商標(biāo)許可合同,使用者享有在一定地域和時(shí)間范圍內(nèi)的商標(biāo)使用權(quán),保證商品質(zhì)量并支付使用費(fèi)用。許可合同期間商標(biāo)增值部分及其利益分配需要在合同中明確約定;合同期滿后,如無特別約定,商標(biāo)使用者不能分配和轉(zhuǎn)移商標(biāo)增值部分及其商譽(yù)。商譽(yù)的移轉(zhuǎn)只能發(fā)生在同一商標(biāo)權(quán)的出讓上。加多寶利用其已有的商標(biāo)、商號和特有的商品包裝裝潢等商譽(yù)載體,通過廣告宣傳和市場營銷手段,不斷經(jīng)營商標(biāo)并累積自身的商譽(yù),不能認(rèn)為是對王老吉商譽(yù)的移植。
[Abstract]:In order to protect the interests of trademark users, trademark users should be defined in different contexts. For a trademark license contract, the user has the right to use the trademark within a certain area and time range, to ensure the quality of the goods and to pay for the use of the trademark. After the expiration of the contract, if there is no special agreement, the trademark user can not distribute and transfer the value-added part of the trademark and its goodwill. The transfer of goodwill can only take place in the transfer of the same trademark right. Using its existing trademarks, trade names and special commodity packaging and decoration carriers, through advertising and marketing means, Gadobo continuously manages trademarks and accumulates its own goodwill, which cannot be regarded as a transplant of Wang Laoji's goodwill.
