【摘要】:正一、現(xiàn)實(shí)困境與追問:不可量物侵害補(bǔ)償?shù)闹贫日系K[案例1]A訴B環(huán)境衛(wèi)生管理處公廁臭氣污染、通風(fēng)、采光糾紛一案。原告孟某訴稱,被告B在A商品房后面僅1.3米處建造一處公廁,違反國家規(guī)定對(duì)公廁建筑與居民住宅之間距離不得低于50米的規(guī)定,公廁由于緊鄰原告的商品房,不僅嚴(yán)重影響原告的通風(fēng)、采光而且公廁發(fā)出的臭氣嚴(yán)重影響原告的正常生活,為此,起訴請(qǐng)求排除妨礙。被告B辯稱,該公廁是征詢住宅小區(qū)的大部分業(yè)主的意見并取得建設(shè)許可證的前提下在原老廁基礎(chǔ)上翻建而成,要拆除妨礙就必須拆除公廁,然而拆除公廁對(duì)小區(qū)的100多戶家中沒有廁所的業(yè)主帶來不便,100多戶業(yè)主不
