論賈誼的“禮法”觀

【摘要】： 賈誼,西漢時期著名的思想家、政治家、文學家。他不僅繼承了儒家的文化理念,而且將法、道等各家的思想相融合。通過對漢初社會的現(xiàn)狀進行分析與研究,形成了獨具特色的“禮法”觀。 本文從賈誼禮法觀的起源、內(nèi)容、特點、影響等方面,對其展開了探究。通過研究,筆者認為,賈誼的“禮法觀”既是對先秦諸子禮法思想的批判繼承,也是對漢代實現(xiàn)長治久安的社會理想的途徑設計與前景展望,其中不乏合理成份,值得今人借鑒。 筆者認為,賈誼將先秦諸子尤其是先秦儒家的禮法思想進行了制度化的提升和深化,是賈誼禮法觀的突出貢獻。其次,賈誼強調(diào)“禮法合流”的綜合治理在實現(xiàn)社會有序中的價值與意義的思想,對當代中國建設和諧社會,具有重要的啟迪意義。盡管賈誼的這些思想因受到漢代各種條件的限制而未能最終變成現(xiàn)實,但是,其禮法觀對后世的深遠影響,是不可否認的歷史事實。 為此,本文從四個方面對賈誼的“禮法”觀進行探討。第一章,論述賈誼“禮法”觀形成的歷史條件和理論基礎;第二章,重點介紹賈誼“禮法”觀的體系構(gòu)成;第三章,對賈誼與孔、孟、荀“禮法”觀進行比較;第四章,論述賈誼“禮法”觀歷史影響與當代啟示。
[Abstract]:Jia Yi, a famous thinker, politician and writer in the Western Han Dynasty. He not only inherits the Confucian cultural idea, but also merges the thoughts of law, Tao and so on. Through the analysis and study of the present situation of the early Han Dynasty, the unique concept of "etiquette law" was formed. This paper probes into the origin, content, characteristics and influence of Jia Yi's concept of etiquette and law. Through the research, the author thinks that Jia Yi's "concept of etiquette and law" is not only a critical inheritance of the thought of etiquette and law of the pre-Qin Dynasty, but also a way to design and prospect the social ideal of achieving lasting peace and stability in the Han Dynasty, in which there are some reasonable elements. It is worth learning from today's people. The author thinks that Jia Yi has institutionalized the thought of etiquette and law of the pre-Qin scholars, especially the pre-Qin Confucianism, which is the outstanding contribution of Jia Yi's concept of etiquette and law. Secondly, Jia Yi emphasizes the value and significance of the comprehensive management of "the confluence of etiquette and law" in realizing the social order, which has important enlightening significance to the construction of harmonious society in contemporary China. Although these thoughts of Jia Yi could not be turned into reality because of the restrictions of various conditions in the Han Dynasty, the profound influence of his concept of etiquette and law on later generations is an undeniable historical fact. Therefore, this paper probes into Jia Yi's concept of etiquette and law from four aspects. The first chapter discusses the historical conditions and theoretical basis for the formation of Jia Yi's concept of "etiquette and law", the second chapter focuses on the system composition of Jia Yi's "rite and law" view, the third chapter compares Jia Yi's concept with that of Kong, Meng and Xun's; Chapter four discusses the historical influence and contemporary enlightenment of Jia Yi's concept of Rite Law.
