【摘要】：法律現(xiàn)代化是社會發(fā)展進程在法律層面上的體現(xiàn),是法律從傳統(tǒng)向現(xiàn)代的一個轉(zhuǎn)變過程。世界各國法律現(xiàn)代化的主流發(fā)展模式以其推動力量的不同可以劃分為兩種。一種是在社會內(nèi)部力量推動下引起的法律從傳統(tǒng)向現(xiàn)代的轉(zhuǎn)型,即社會推進型(內(nèi)源型)模式；另一種是在一國政府的主導下,由外部較先進的法律制度通過對本國較落后法律制度的沖擊而發(fā)生的法律轉(zhuǎn)型,即政府推進型(外發(fā)型)模式。本文通過對第一種模式的典型代表——西方社會法律現(xiàn)代化進程的具體分析,闡述了西歐社會推進型法律現(xiàn)代化模式的具體內(nèi)容和表現(xiàn)形式,探究其存在的社會背景和發(fā)展方向,分析了市民社會對西歐法律現(xiàn)代化的作用,同時比較了政府在不同模式下的功能表現(xiàn)。將西歐社會和政府的作用機理,結(jié)合到我國的政府主導型進程中。探索我國法律現(xiàn)代化進程的發(fā)展脈絡和改革方向,將政府與社會力量有機結(jié)合,通過平衡政府和社會二者在法律現(xiàn)代化中的地位和作用,確立法律現(xiàn)代化的合理道路,推動我國法治現(xiàn)代化建設,實現(xiàn)國家的法治目標。
[Abstract]:The modernization of law is the embodiment of the process of social development on the level of law, and it is a transformation process of law from tradition to modern. The mainstream development mode of legal modernization in the world can be divided into two kinds according to its driving force. One is the transformation of law from traditional to modern, which is caused by the internal forces of society, that is, the mode of social propulsive (endogenous); The other is the legal transformation that occurs through the impact of a relatively advanced external legal system under the leadership of a government, that is, the government-driven (external hairstyle) model. Through the concrete analysis of the process of the modernization of western social law, which is the typical representative of the first mode, this paper expounds the concrete content and manifestation of the mode of the legal modernization of the social propulsive type in Western Europe. This paper probes into the social background and development direction of its existence, analyzes the role of civil society in the modernization of western European law, and compares the functions of the government in different modes. The action mechanism of the society and government in Western Europe is combined with the process of government leading in our country. This paper explores the development and reform direction of the process of legal modernization in China, organically combines the government and social forces, and establishes a reasonable road for the modernization of law by balancing the position and role of the government and the society in the modernization of law. Promote the modernization of our country's rule of law and realize the country's goal of ruling by law.
