【摘要】：器官移植技術(shù)的迅速發(fā)展給器官疾病患者帶來了福音。雖然我國的器官移植醫(yī)學(xué)臨床起步較晚，但器官移植技術(shù)的進(jìn)步相對較快。尤其是近年來，我國的器官移植技術(shù)發(fā)展迅速，規(guī)模擴(kuò)大。然而于此相對，盡管我國在器官移植的醫(yī)學(xué)實(shí)踐方面已經(jīng)跨入世界先進(jìn)領(lǐng)域，但對器官移植的法律研究和相關(guān)立法卻比較滯后，這一點(diǎn)導(dǎo)致了人體器官在摘取、移植的過程中面臨著許多需要解決的法律問題和需要完善的法律空白地帶。鑒于此我國立法機(jī)關(guān)可以借鑒國外的立法經(jīng)驗(yàn)，在現(xiàn)有的器官移植相關(guān)法律法規(guī)的基礎(chǔ)上，進(jìn)一步制定器官移植和器官捐獻(xiàn)統(tǒng)一的法律來完善器官移植的法律體系，以推動我國器官移植事業(yè)的健康發(fā)展，挽救更多患者的生命。 本選題分為三個(gè)部分。第一部分從立法目的、立法適用范圍以及法律基本原則對中德器官移植法的一般規(guī)定進(jìn)行比較。第二部分對中德器官移植法的基本制度分別予以介紹，進(jìn)行供體、受體范圍、醫(yī)生說明義務(wù)、捐贈者同意等方面的對比。第三部分是對中德器官移植法法律責(zé)任的比較分析。每一部分中都對我國立法需改進(jìn)的地方提出了本文的見解與建議。
[Abstract]:The rapid development of organ transplantation technology brings good news to patients with organ diseases. Although the clinical application of organ transplantation medicine in China is relatively late, the progress of organ transplantation technology is relatively rapid. Especially in recent years, organ transplantation technology in China has developed rapidly and expanded in scale. However, in contrast, although our country has stepped into the advanced field of medical practice of organ transplantation in the world, the legal research and relevant legislation on organ transplantation are lagging behind, which has led to the removal of human organs. In the process of transplantation, there are many legal problems and gaps that need to be solved. In view of this, the legislature of our country can learn from the legislative experience of foreign countries, and on the basis of the existing laws and regulations on organ transplantation, we can further formulate a unified law on organ transplantation and organ donation to perfect the legal system of organ transplantation. In order to promote the healthy development of organ transplantation in China, save more patients' lives. This topic is divided into three parts. The first part compares the general provisions of Chinese and German organ transplantation law from the legislative purpose, the scope of application of legislation and the basic principles of law. The second part introduces the basic system of organ transplantation in China and Germany, compares donor, recipient range, doctor's obligation of explanation, donor's consent and so on. The third part is the comparative analysis of the legal liability of organ transplantation between China and Germany. In each part, the author puts forward some opinions and suggestions for the improvement of our country's legislation.
