【摘要】：近年來英國行政裁判所的改革主要集中在組織體系和程序規(guī)則領(lǐng)域。組織體系方面,行政裁判所已經(jīng)成為獨(dú)立的司法裁判機(jī)構(gòu),將無序的各類裁判所納入到新的兩級管理體系當(dāng)中;審判人員的選任也在專業(yè)性的基礎(chǔ)上排除了行政權(quán)的干預(yù)。程序規(guī)則由新設(shè)立的行政裁判所程序委員會統(tǒng)一制定,按照司法化模式設(shè)計,在保證公正性的前提下盡量簡化,以便于相對人的使用。組織體系和程序規(guī)則的變革有利于行政爭議解決的獨(dú)立性、專業(yè)性和公正性。
[Abstract]:In recent years, the reform of British administrative adjudication mainly focuses on the organizational system and procedural rules. In terms of organizational system, the administrative adjudication office has become an independent judicial organ, which brings all kinds of disordered adjudicators into the new two-level management system; the selection and appointment of judges also excludes the interference of administrative power on the basis of professionalism. The rules of procedure are formulated by the newly established procedure committee of the administrative tribunal, designed according to the mode of judicature and simplified under the premise of ensuring fairness, so as to facilitate the use of the relative party. The reform of organizational system and procedural rules is conducive to the independence, professionalism and impartiality of administrative dispute resolution.
