【摘要】：通過鄉(xiāng)土法杰的糾紛解決展現(xiàn)了我國鄉(xiāng)村社會人們生活事實的復(fù)雜圖景。鄉(xiāng)土法杰作為鄉(xiāng)村糾紛解決的主體,所面對的鄉(xiāng)村糾紛具有類型多樣、成因復(fù)雜、解決困難等特點,他們根據(jù)鄉(xiāng)土社會人們生活的實際情況,基于追求實效、解決問題的目的,秉持講道理、重公正的原則,依據(jù)法律、習(xí)慣法等多元規(guī)范,采用調(diào)解、參與訴訟及其他不同的解紛方式,獲得了較好的解紛結(jié)果和社會效果。鄉(xiāng)土法杰的糾紛解決蘊含鄉(xiāng)土社會民眾的生活智慧,可為我國當(dāng)下國家法意義上的以訴訟為主的社會糾紛解決途徑的發(fā)展改善提供有益的啟發(fā)。
[Abstract]:The dispute resolution of local Faget shows the complicated picture of people's life in rural society in our country. As the main body of rural dispute resolution, local Faget faces various types of rural disputes, complex causes and difficulties in solving them. According to the actual conditions of people's life in rural society, they seek practical results and solve problems. Adhering to the principle of reasonableness and justice, according to the pluralistic norms of law and customary law, mediation, participation in litigation and other different ways of resolving disputes, good results and social effects have been obtained. The dispute resolution of local Faget contains the life wisdom of the local people, which can provide beneficial inspiration for the development and improvement of the social dispute resolution in the sense of national law of our country.
