【摘要】： 近些年,中國(guó)處于社會(huì)轉(zhuǎn)型時(shí)期,經(jīng)濟(jì)政治和文化都處于發(fā)展時(shí)期,但是由于發(fā)展的先后問(wèn)題,在不同地區(qū)經(jīng)常會(huì)由于各種問(wèn)題出現(xiàn)一些危害社會(huì)穩(wěn)定和發(fā)展的群體事件。而本文主要研究民轉(zhuǎn)刑這類(lèi)群體事件的發(fā)生原因和過(guò)程,以期可以找到更好的方式預(yù)防今后民轉(zhuǎn)刑類(lèi)群體事件的發(fā)生。近些年,司法機(jī)關(guān)接觸的案件中,民轉(zhuǎn)刑的案件越來(lái)越多,受到司法機(jī)關(guān)和法律學(xué)者越來(lái)越多的重視。民轉(zhuǎn)刑類(lèi)群體事件具有很強(qiáng)的隱蔽性、突發(fā)性和極大的危害性,如果不能在事發(fā)之前及時(shí)發(fā)現(xiàn),早日解決,就容易釀成危害穩(wěn)定、有損政府形象的群體性事件。因此,必須正確認(rèn)識(shí)當(dāng)前民轉(zhuǎn)刑類(lèi)群體事件產(chǎn)生的原因,盡快建立健全預(yù)防和調(diào)控突發(fā)性群體事件的運(yùn)行機(jī)制,探索正確處理突發(fā)性群體事件的策略和方法,以維護(hù)社會(huì)的穩(wěn)定和發(fā)展。 本文共分為五章,對(duì)我國(guó)民轉(zhuǎn)刑類(lèi)群體事件進(jìn)行了深入研究。主要內(nèi)容包括:首先是文章的緒論部分,介紹了本論文的選題背景、意義、文獻(xiàn)綜述、研究方法和創(chuàng)新點(diǎn)。第二章,對(duì)民轉(zhuǎn)刑類(lèi)群體事件進(jìn)行了理論分析,對(duì)民轉(zhuǎn)刑再轉(zhuǎn)為群體事件的原因從社會(huì)發(fā)展和事件主體等多方面進(jìn)行了分析,這部分是文章的重點(diǎn)也是創(chuàng)新點(diǎn);之后對(duì)民轉(zhuǎn)刑再轉(zhuǎn)為群體事件的四個(gè)階段——萌芽、爆發(fā)、擴(kuò)散和平息進(jìn)行了闡述。第三章,著重對(duì)民轉(zhuǎn)刑再轉(zhuǎn)為群體的一些典型案例進(jìn)行闡述,以印證以上理論部分。第四章針對(duì)前文的敘述,提出了對(duì)民轉(zhuǎn)刑類(lèi)群體事件事前預(yù)防、事發(fā)時(shí)的控制處理以及事態(tài)緩和后的信息反饋的對(duì)策,在參考其他學(xué)者的觀點(diǎn)的基礎(chǔ)上,做出了自己的總結(jié)和敘述。最后一部分是本文的結(jié)論,總結(jié)全文。
[Abstract]:In recent years, China is in a period of social transformation, economic, political and cultural development period, but due to the development of the sequence of problems, in different regions often due to a variety of problems to endanger social stability and development of a number of group events. This paper mainly studies the cause and process of the group events, in order to find a better way to prevent them from happening in the future. In recent years, there are more and more cases of people transferring to punishment in the cases contacted by judicial organs, which are paid more and more attention by judicial organs and legal scholars. The group events of people to criminal cases have strong concealment, paroxysmal and great harmfulness. If they can not be found in time before the incident and solved as soon as possible, they will easily lead to group incidents that endanger stability and damage the image of the government. Therefore, it is necessary to correctly understand the causes of the current mass events, establish and improve the operation mechanism of preventing and controlling the sudden mass events as soon as possible, and explore the strategies and methods of correctly dealing with the sudden mass events. To maintain social stability and development. This paper is divided into five chapters. The main contents are as follows: first, the introduction of the paper introduces the background, significance, literature review, research methods and innovation. In the second chapter, the author makes a theoretical analysis of the group events from people to criminals, and analyzes the causes of the conversion from social development and the subject of events, which is the focus of the article and innovation; After that, the paper expounds the four stages of turning people's punishment into group events-germination, outbreak, diffusion and appeasement. The third chapter focuses on some typical cases of people changing from punishment to group in order to confirm the above theoretical part. In the fourth chapter, according to the previous narration, the author puts forward the countermeasures of prevention beforehand, the control and handling of the incident and the information feedback after the situation is alleviated, on the basis of referring to the views of other scholars. He made his own summary and narration. The last part is the conclusion of this paper, summing up the full text.
