【摘要】： 批評(píng)性語(yǔ)篇分析產(chǎn)生于20世紀(jì)70年代末,它是以揭示語(yǔ)言、權(quán)利和意識(shí)形態(tài)的潛在關(guān)系為目的的。在他們看來(lái),任何語(yǔ)篇都不是絕對(duì)客觀的,而或多或少都會(huì)受到意識(shí)形態(tài)或其它因素的影響,因此,本文便以此作為依據(jù),運(yùn)用費(fèi)爾克拉夫的三項(xiàng)度模式和韓禮德的系統(tǒng)功能語(yǔ)法理論對(duì)中國(guó)的法律語(yǔ)篇進(jìn)行分析,以此來(lái)揭示隱藏在法律語(yǔ)篇中的權(quán)力意識(shí)。 本文的整個(gè)分析過(guò)程是從宏觀和微觀兩個(gè)角度進(jìn)行的。首先,筆者借用韓禮德的系統(tǒng)功能語(yǔ)法、對(duì)語(yǔ)篇的語(yǔ)言特征:詞匯、轉(zhuǎn)化、情態(tài)和及物性等進(jìn)行了描述,并分析了權(quán)力意識(shí)在這一過(guò)程是如何實(shí)現(xiàn)的;然后,筆者又以費(fèi)爾克拉夫的三項(xiàng)度模式為依據(jù),結(jié)合社會(huì)和歷史條件來(lái)解釋法律語(yǔ)篇和社會(huì)結(jié)構(gòu)的關(guān)系,也就是說(shuō)明社會(huì)條件如何影響法律語(yǔ)篇的生成,以及法律語(yǔ)篇又對(duì)這些社會(huì)條件有哪些影響。 本文的最后結(jié)論是:法律語(yǔ)篇作為國(guó)家調(diào)控社會(huì)關(guān)系及保障社會(huì)運(yùn)行的手段,必然要體現(xiàn)一定的權(quán)力意識(shí),且這種權(quán)力意識(shí)是不可避免的。因此,這就要求立法者或其它法學(xué)人士要充分意識(shí)到這一點(diǎn),在制定法律及運(yùn)用法律時(shí),既要考慮它的權(quán)威性及強(qiáng)制性,同時(shí)也要考慮被統(tǒng)治階級(jí)的可承受性。
[Abstract]:Critical discourse analysis (CDA), which originated in the late 1970s, aims to reveal the potential relationship among language, rights and ideology. In their view, any text is not absolutely objective, but is more or less influenced by ideology or other factors. Based on Felke's trichotomy model and Halliday's systematic functional grammar theory, the author analyzes the Chinese legal discourse in order to reveal the consciousness of power hidden in the legal discourse. The whole analysis process of this paper is carried out from both macro and micro angles. First of all, the author uses Halliday's systemic functional grammar to describe the linguistic features of the discourse: vocabulary, transformation, modality and transitivity, and analyzes how power consciousness is realized in this process. The author also explains the relationship between legal discourse and social structure on the basis of Felke's three-degree model, combining with social and historical conditions, that is to say, how social conditions affect the formation of legal discourse. And the influence of legal discourse on these social conditions. The final conclusion of this paper is that legal discourse, as a means for the state to regulate social relations and ensure social operation, must embody a certain sense of power, and this kind of power consciousness is inevitable. Therefore, this requires legislators or other jurists to be fully aware of this point. When making laws and applying laws, they should not only consider its authoritativeness and compulsion, but also the affordability of the ruling class.
