【摘要】：法治解決問題的方式是:面對(duì)權(quán)益互相沖突的雙方主張,必須作出支持一方、反對(duì)另一方的抉斷,如或肯定或否定、或侵權(quán)或不侵權(quán)、或犯罪或不犯罪等。這是一種"二選一"的解決問題方式,具有武斷性特征。法治解決問題方式產(chǎn)生的原因有:事物的本性使然;規(guī)則的本性使然;為了社會(huì)生活的清楚、簡(jiǎn)便、高效;通過法學(xué)教育和法律實(shí)踐的形成等。其不足主要是突出的僵硬性與明顯的呆板性,這可以通過法律的內(nèi)部補(bǔ)償與外部補(bǔ)償進(jìn)行完善。法治解決問題的方式對(duì)社會(huì)的意義是供給良法,對(duì)社會(huì)管理的意義是形成基礎(chǔ),對(duì)社會(huì)管理創(chuàng)新的意義是促進(jìn)善治。
[Abstract]:The rule of law can solve the problem in the face of conflict of rights and interests of both sides, must support one side, against the other side of the judgment, such as affirmative or negative, or tort or not infringement, or crime or not, and so on. This is a "choose one from the two" way of solving the problem, with arbitrary characteristics. The causes of solving problems by rule of law are: the nature of things; the nature of rules; for the sake of social life clear, simple and efficient; through legal education and legal practice, etc. Its deficiency is the prominent rigidity and the obvious rigidity, which can be perfected by the internal and external compensation of the law. The way of solving problems by rule of law is to provide good law to the society, to the social management is to form the foundation, and to the innovation of social management is to promote good governance.
