【摘要】：社會(huì)的存在和發(fā)展,需要社會(huì)秩序和維護(hù)社會(huì)秩序的社會(huì)控制,而且,社會(huì)控制的方式和手段多種多樣。清代,特殊的社會(huì)環(huán)境使得習(xí)慣法與國(guó)家法在少數(shù)民族自治權(quán)、旗民交產(chǎn)、宗族法規(guī)、民間契約、典賣(mài)女子、官方審判等方面互動(dòng)并進(jìn),相互彌補(bǔ),共同實(shí)現(xiàn)社會(huì)控制的目的。由此可見(jiàn),中國(guó)鄉(xiāng)土社會(huì)的法制現(xiàn)代化,既要借鑒、吸收、變通世界上先進(jìn)的法制經(jīng)驗(yàn)與技術(shù),為我所用,又要尊重中國(guó)傳統(tǒng)法律文化中仍然存在且發(fā)揮巨大社會(huì)功效的精華。只有如此,才能真正走出一條適合自己的具有中國(guó)特色的社會(huì)主義法制道路。
[Abstract]:The existence and development of society require social order and social control to maintain social order, and there are various ways and means of social control. In the Qing Dynasty, the special social environment made the customary law and the state law interacted with each other in the aspects of minority autonomy, banners, clan laws and regulations, folk contracts, canon selling women, official trials and so on, so as to make up for each other and jointly realize the purpose of social control. It can be seen from this that the modernization of the legal system in China's local society should not only draw lessons from, absorb and adapt the advanced legal experience and technology in the world, but also respect the essence of Chinese traditional legal culture that still exists and exerts great social effects. Only in this way, can we really find a socialist legal system with Chinese characteristics.
