【摘要】：邊沁基于功利主義和擬制理論對近代社會契約論進(jìn)行了批判。本文分析了邊沁批判社會契約論的內(nèi)在理路和服從習(xí)慣概念的內(nèi)涵,并認(rèn)為他實(shí)際上用基于功利考量的服從習(xí)慣取代了社會契約,并把服從習(xí)慣作為政治合法性和政治義務(wù)的來源,這為他后期主權(quán)理論奠定了基礎(chǔ),也是近代自由主義內(nèi)部理論轉(zhuǎn)型的表現(xiàn)。分析邊沁對社會契約論的批判有助于從功利主義的角度重新審視近代自由主義的發(fā)展。
[Abstract]:Bentham criticizes modern social contract theory based on utilitarianism and fictitious theory. This paper analyzes the connotation of Bentham's critique of the concept of "social contract", and thinks that he has actually replaced the social contract with the habit based on utilitarian consideration. Taking the custom as the source of political legitimacy and political obligation, it laid a foundation for his later sovereignty theory, and it was also the manifestation of the transformation of the internal theory of modern liberalism. The analysis of Bentham's criticism of social contract helps to re-examine the development of modern liberalism from the perspective of utilitarianism.
