【摘要】：正十八大報(bào)告指出,"要提高領(lǐng)導(dǎo)干部運(yùn)用法治思維和法治方法深化改革、推動(dòng)發(fā)展、化解矛盾、維護(hù)穩(wěn)定能力",再次強(qiáng)調(diào)了執(zhí)政黨要依法執(zhí)政,政府要依法行政,領(lǐng)導(dǎo)干部在工作中也要依法辦事。不可否認(rèn),經(jīng)過(guò)近幾十年的實(shí)踐探索,我國(guó)社會(huì)法治化進(jìn)程明顯加快,依法治國(guó)、依法辦事已經(jīng)成為普遍共識(shí),各級(jí)領(lǐng)導(dǎo)干部法律素養(yǎng)不斷增強(qiáng),依法決策、依法行政水平有了很大提升。但是,人治思維和人治方式還頗受一些領(lǐng)導(dǎo)干部的青睞,以言代法、以權(quán)壓法、徇私枉法的現(xiàn)象并不鮮見(jiàn)。一、領(lǐng)導(dǎo)者人治偏好的現(xiàn)實(shí)基礎(chǔ)分析盡管黨的十五大已經(jīng)將"依法治國(guó),建設(shè)社會(huì)主義法治國(guó)家"確立
