【摘要】： 本文從分析法律變遷和文化這兩者的內(nèi)涵入手,繼而分析影響法律變遷的諸多因素;從中發(fā)現(xiàn)文化因素是影響法律變遷的核心因素,傳統(tǒng)文化尤其是傳統(tǒng)法律文化的發(fā)展是法律變遷的根本動因,而法律變遷也是文化變遷,尤其是法律文化變遷的重要方式和體現(xiàn),法律變遷的模式選擇更是決定著法律文化變遷的最終效果,也直接關(guān)系著變遷后的法律的實效。通過對文化因素在法律變遷過程中的影響進行進一步的探討,并在此基礎(chǔ)上以中西文化傳統(tǒng)對中國法律變遷的影響為例,從法律移植和法律繼承兩種途徑的文化基礎(chǔ)的分歧入手,分析了價值沖突在法律變遷中的核心作用,并提出文化層面的價值整合對法律變遷的核心即法律精神變遷的重要性。本文的分析試圖通過對文化施與法律變遷過程的影響的考察,對現(xiàn)實中法律制度的完善給予理念上的梳理和實踐上的合理指導(dǎo)。
[Abstract]:This paper begins with the analysis of the connotation of legal change and culture, and then analyzes the factors that influence the changes of law. It is found that cultural factors are the core factors affecting the changes of law. The development of traditional culture, especially traditional legal culture, is the fundamental cause of the changes of law, and the changes of law are also the cultural changes, especially the legal texts. The choice of the mode of the change of law determines the final effect of the change of law culture as well as the actual effect of the law after the change. Taking the influence as an example, starting from the differences of the cultural basis between the legal transplantation and the legal inheritance, this paper analyzes the core role of the value conflict in the legal vicissitude, and puts forward the importance of the value integration at the cultural level to the core of the legal vicissitude, namely the vicissitude of the legal spirit. The investigation of the influence gives reasonable guidance to the perfection of the legal system in practice.
