【摘要】： 普通法作為當(dāng)今世界兩大法系之一,判例法制度、遵循先例原則、程序先于權(quán)利等原則是普通法特有的原則和制度,這些法律原則、制度的形成扎根于英國(guó)的封建社會(huì)制度,同時(shí)也體現(xiàn)了英國(guó)的文化傳統(tǒng)和人文關(guān)懷,本文將以英國(guó)文化為視角,探索英國(guó)文化傳統(tǒng)的歷史根源和對(duì)普通法基本原則的影響,進(jìn)而探索代表現(xiàn)代社會(huì)普通法系的英國(guó)法制現(xiàn)代化模式進(jìn)程,揭示英國(guó)法治的發(fā)展道路,法律面前的平等,或社會(huì)所有的階層都要平等地服從由普通法院管轄的國(guó)家境內(nèi)的普通法律。
[Abstract]:As one of the two major legal systems in the world today, the system of case law follows the principle of precedent and the principle of procedure before right is the unique principle and system of common law. The formation of these legal principles and systems is rooted in the feudal society system of England. At the same time, it also reflects the British cultural tradition and humanistic concern. From the perspective of British culture, this paper explores the historical origin of British cultural tradition and its influence on the basic principles of common law. Then it explores the process of the modernization of the British legal system, which represents the common law system of the modern society, and reveals the development of the rule of law in Britain and the equality before the law. Or all sectors of society must be equally subject to the common law of countries subject to the jurisdiction of ordinary courts.
