【摘要】：辛亥革命后,納妾之俗并未由此逆轉,妾制由此面對社會與法律的雙重困境。民初大理院在處理妾制時,既照顧到了現(xiàn)行律的基本法意,同時又努力擺脫現(xiàn)行律的保守立場,力圖雜糅以西式的法理,在細節(jié)上加以調和。因此,在新舊時代轉換的當口,既沒有完全拋棄現(xiàn)行的舊法,又沒有一味地適用外來的新法,使當時的法制得以在社會現(xiàn)實的基礎上漸進更新。
[Abstract]:After the Revolution of 1911, the custom of concubinage was not reversed, and the concubinage system faced the double predicament of society and law. In the early days of the Republic of China, when dealing with the concubinage system, Dali Institute not only took into account the basic legal meaning of the current law, but also tried to get rid of the conservative position of the current law and tried to mix it up with the western legal theory and reconcile it in detail. Therefore, at the time of the transition of the new and the old, neither the existing old laws nor the foreign new laws were completely abandoned, so that the legal system at that time was gradually updated on the basis of social reality.
